CHAMBER OF THE CITY COUNCIL CITY HALL, STEPHENVILLE, TEXAS The City Council of the City of Stephenville, Texas met Tuesday, March 4, 1980 at 7 o'clock p.m. with Mayor Donald R. Jones present and presiding. COUNCILMEMBERS PRESENT: Mike Leese W. M. Irwin Calvin A. Zonelle Peters - Mr. Larry McGee - & Class and members of the press. Mayor Jones called the meeting to order. ITEM I: APPROVAL OF THE MINUTES Councilman Leese moved, seconded by Councilman Hammett, that the the minutes of the meeting of February 5,1980 be approved as written. Motion carried unanimously. ITEM II: FOR PURCHASE OF A BOO FOR THE FIRE Administrative Assistant Kurt Ackermann presented the following bids for the purchase of one (1) 1980 new model 22 ton cab and chassis to replace the 1959 Ford truck now being used by the Fire Department: 1. Bruner Chevrolet Co.------- - - - - -- $11,979.13 Stephenville, Texas 2. Harbin Buick- Pontiac- GMC --------- $12,402.16 Stephenville, Texas 3. Pollan -Blue Ford ----------------- $12,997.63 Stephenville, Texas Councilman McGee moved, seconded by Councilman Leese, that the City Council accept the low bid submitted by Bruner Chevrolet Co. of Stephenville, Texas, in the amount of $11,979.13 for the purchase of one (1) 1980 2Z ton cab and chassis for a booster truck for the Fire Department. Motion carried unanimously. ITEM III: PLANNING & ZONING COMMISSION RECOMMENDATIONS - #94 Mayor Jones advised that the Planning & Zoning Commission had made the following recommendations to the City Council: 1. To rezone from R -1 to B -2 the J. M. James Property, 1521 Lingle - ville Road - the Gaines Riley Property, 1531 Lingleville Road and the W. B. Trigg Property, 1500 block of Lingleville Road. Said property being Lots D, E, F and G, Block 5, McAlister Second Addition. Councilman Irwin moved, seconded by Councilman Riggins, that April 8, 1980 at 7 o'clock p.m. in the Council Chambers be the date, time and place for a public hearing for the Council to consider the recommendation of the Planning & Zoning Commission to rezone Lots D, E, F, and G, Block 5, McAlister Second Addition, from R -1 to B -2. Motion carried unanimously. 2. That the Zoning Ordinance be amended to specifically include a carwash in a B -2 zoned area. Councilman Irwin moved, seconded by Councilman Ferguson, that an ordinance be prepared for action at the next regular meeting to include a carwash in the B -2 portion of the Zoning Ordinance. Motion carried unanimously. 3. Approval of the Tanglewood Estates Preliminary Plat with the following changes: a. To extend the furtherest street south to the property line (Lot 15, Block l). b. The resolution of the 16' easement on the Brazos Electric Company's 60' easement. Director of Public Works R. Y. Gann discussed the plat with the Council and he recommended approval of the plat with the stated changes in the extension of the street and the resolution of the utility easement. After considerable discussion, Councilman Anderson moved, seconded by Councilwoman Chew, that the City Council accept the recommen -. dation of the Planning & Zoning Commission and approve the Tanglewood Estates Preliminary Plat with the following changes: a. The extension of the furtherest 50' street on the south through Lot 15, Block 1, to the property line. b. The resolution of the utility easement. Motion carried unanimously. ITEM IV: CONSIDERATION OF ANNEXATION ORDINANCE OF Mayor.Jones advised that the petition and the metes and bounds of the Tanglewood Estates Addition had been filed in the February 19th meeting and the 20 days have not elapsed as required by the City Charter, there- fore, the Council cannot take action on the annexation at this time. Mayor Jones, with the consent of the Council, moved the Regular Meeting date of the City Council from April 1st to April 8th so that the election returns could be canvassed without having a special meeting. Mayor Jones also advised that the Council would act on the annexation of the Tanglewood Estates Addition in the April 8th meeting. ITEM V: ANNEXATION OF THE GOLF COUNTRY ESTATES ADDITION 111 101affGWT" AN ORDINANCE MAKING A PART OF THE CITY OF STEPHENVILLE LAND ADJACENT THERETO AND BEING 169.34 ACRES OF THE JARRETT MENEFEE SURVEY WHICH IS DESCRIBED BELOW AND WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE FULLY DESCRIBES SAID LAND: After some discussion, Councilman Leese moved, seconded by Councilman Irwin, that the ordinance annexing 169.34 acre tract of land making up the Golf Country Estates be approved as read. Motion carried unanimously. ]4 Mayor Jones advised that he was setting a meeting for Friday, March 21, 1980 at 3 o'clock p.m. for the purpose of considering a preliminary plat and rezoning application that is being made by Golf Country Estates and will be processed by the Planning & Zoning Commission, hopefully, prior to that time. If it is. not,.then the meeting will be cancelled. ITEM VI: APPROVAL OF DELINQUENT TAX ROLL TABLED - #515 Tax Assessor /Collector Robert Groves did not have the delinquent tax roll ready for approval. ITEM VII: PARKS & RECREATION DEPARTMENT REPORT BY RONNIE ISHAM - #523 Director of Parks & Recreation Ronnie Isham presented an annual depart- ment report. In his report Mr. Isham mentioned the following projects that his department had done - are in the process of doing - will be doing in the coming year: Have completed the dirt work on the new soccer field with the help of the Street Department - The July 4th Family Fun Fair plans are underway - The construction of the foot bridge is progressing slowly - - -The new turf vehicle will be in use this summer - The YC-C program has-been approved - Have begun seasonal maintenance on the ball fields.- are enlarging the dugouts at McCleskey Field - the tennis courts are to be refinished - Have hired Steve Madison as the new Parks & Recreation Coordinator - Have done some repair work at the Graves Recreation Center and the Senior Citizens Center ITEM VIII: OLD BUSINESS None ITEM IX: NEW BUSINESS (Discussion Only) - #734 Mayor Jones advised that a complaint had been filed against a city employee. He appointed a committee of Councilmen Riggins, Hammett, and Irwin with Councilman Irwin as chairman, with ex officio members being the Chief of Police, the City Administrator and the City Attorney to consider the complaint. Mayor Jones directed the committee to get whatever information is necessary and, 1 f necessary, to meet with the parties involved and respond to the complaint. If that is not satis- factory, there is an appeal process to the City Council in general. Mayor Jones said that a complete procedure on complaints against city employees has never been worked up and he will submit one in writing at the next meeting so there will be no question in the future about what the procedure might be. The Council will discuss them at that time. He said he would submit the complaint to the committee for processing. Councilman Riggins asked what kind of time period was being considered in regard to an elevated storage tank. Mr. Shelton advised that he really did not know. That he hoped it would be three years. Mr. Shelton advised that he thought the grant was about to go through for the new sewer treatment plant. They might be able to start work this fall. Councilman Irwin asked if he had any projected costs on the operation of the new sewer plant. Mr. Shelton said just the electric bill would be about $20,000 per year, then there would be two shifts or 16 hours a day - - so it will be more expensive to operate. The above described land is hereby annexed and made a part of the City of Stephenville by virtue of petition presented to this City Council at meeting held on March 4, 1980 which petition was signed by RON E. DODD, President of Stephenville Savings and Loan Association, which petition is also duly sworn to by said person; and there being no qualified voters living within the above described area which is annexed by this ordinance; and such petition and the facts therein stated authorizing this action hereby taken under the laws of this state and under the Charter and Ordinance of the City of Stephenville and that the Stephenville Savings and Loan Association is the owner of all of said land. The City Council, having a quorum present at this meeting of March 4, 1980, motion was duly made and duly seconded that this ordinance pass, and upon vote said motion carried unanimously. This ordinance shall go into effect immediately and the above described land is hereby declared to be annexed and the same is part of the City of Stephenville as of this date of passage. MOTLEY SURVEY WHICH IS DESCRIBED BELOW AND WHICH JOINS THE PRESENT CITY LIMITS OF THE CITY OF STEPHENVILLE AND WHICH ORDINANCE FULLY DESCRIBES SAID LAND: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: That certain land adjacent to the City of Stephenville and adjoining same and'•s,pecifically described as follows: All that certain 31.81 acre tract of land out of the Wm. Motley Survey, Abstract No. 515 in Erath County, Texas, being part of that certain 405.51 acre tract of land conveyed by Lemuel A. Brock et ux to Stephenville Land, Inc. by deed recorded in Volume 423, Page 451 of the Deed Records of Erath County, Texas, and described as follows: BEGINNING at an iron rod set in the north line of the Stephenville Land, Inc. 405.51 acre tract and in the west line of Dale Avenue North Addition to the City of Stephenville, being in the west line of the present city limits of Stephenville for the NEC of this tract, from which the NEC of the Wm. Jones Councilman Hammett asked Mr. Gann if he thought the elevated storage tank was something that should be considered in the very near future or when? Mr. Gann said he thought it should be included now. That if things develop as has been rumored, such as shopping centers, industries, and residences that the city would need the elevated storage tank before it would need additional wells. Might get it done through -the Texas. Water Development Board. He estimated 1 to l2 years for completion of the sewer treatment ulant. Mr. Gann advised that the cost of operating the new sewer treatment plant would be approximately $65,000 to $70,000 per year. The Council and Mr. Gann discussed the water supply and source.
