CHAMBER OF THE CITY COUNCIL CITY HALL, STEPHENVILLE, TEXAS The City Council of the City of Stephenville, Texas, met in Regular Session Tuesday, June 2, 1981 at 7:00 p.m. with Mayor Joe F. Cummings present and presiding. MEMBERS PRESENT: G. A. Swindle W. M. Irwin Charles Riggins MEMBERS ABSENT: Raymond Anderson William G. Ferguson Larry Hammett David Clayton Mayor Cummings called the meeting to order and declared a quorum present. ITEM I: APPROVALOF MINUTES Councilman Irwin moved, seconded by Councilman Swindle, that the minutes of the May 5, 1981-meeting be approved as written. Motion carried unanimously. JEFF. E OF JAYCEE PARK FOR Mr. Jeff McManus advised the Council that he was appearing before them not as a representative of any organization or association, but as a father. Mr. McManus explained that, due to rapid growth (365 players repre- senting 21 teams), the Soccer Association of Stephenville was in dire need of: more space for soccer fields. He said that, after measuring and checking, the Jaycee Park would provide space for 6 soccer fields, possibly 7 fields. The Soccer Association would provide all needed improvements. Said improvements would not necessitate removing or changing any of the trees, playground equipment or picnic tables that are there now. Mr,, McManus said the Soccer Association was not asking the City to give them the Jaycee Park. The land would still belong to the City Park Department. The Association'Ijiust wants to know that there is a place, if the Association makes the needed improvements, that they can use, without interference, for their soccer games. Should the Council agree, they would like to get started on the fields as soon as possible in in order to have the fields ready for the fall season. Councilman Irwin commented that this should be handled through the Parks & Recreation Department. He said he did not like to by-pass the Park Department administration. 123 Director of Parks & Recreation Ronnie Isham advised the Council that he has a Master Plan for the development of the Jaycee Park.and that he did not feel that he could legally designate that land be used for the Soccer Association exclusively. Mr. Isham said he already has a contract with the federal government, through the YCC Project, for a work program in the Jaycee Park this summer. Also, the Optimist Club has indicated an interest in donating money for the improvement of the park. He said he can provide some more soccer fields, but not 6 or 7 as requested. Councilman Clayton commented that he would like to see the park developed for all types of activities and not be limited to just soccer fields. Mr. Isham advised that past policy has been that if anyone had any monies for improvements to the city parks, they gave this money to the city and the city did the improvements and he did not think they should deviate from that policy. After considerable discussion, Mayor Cummings advised Mr. Isham an Mr. McManus to get together with a map of the Jaycee park and see where the Soccer Association in proposing the fields - - how they can be worked into the park programs, etc. Because there will be an overlay of the soccer spring season and the baseball season, see how many soccer fields will fit in and what he thinks the city can do. The Council wants to do whatever they can do. The Mayor asked Mr. Isham and Mr. McManus to come back to advised the Council as to what can be worked out. HEAR THIRD AND FINAL Mayor Cummings read the Lone Star Gas Company franchise amendment. Councilman Irwin moved, seconded by Councilman Ferguson, that the City Council pass and approve the third and final reading of the amend- ment to the Lone Star Gas franchise which pertains to "yard lines" and "service lines", effective 30 days from this date. Motion carried un- animously. ITEM IV: CONSIDER GULF STATES TELEPHONE FRANCHISE. Mayor Cummings advised the Council that Gulf States Telephone fran- chise had expired quite some time ago and a new one was needed. He read the franchise heading. Mayor Cummings appointed Councilmen Swindle, Riggins and Irwin as a committee to study this franchise to see if it meets the requirements of the city and report back to the Council at the next meeting at which time there will be a second reading of the franchise. ITEM V: HEAR CECIL DAVIS REGARDING AIRPORT MANAGEMENT CONTRACT. Prior to this meeting Mr. Davis requested this item be cancelled. CONSIDER AMENDING SECTION 13-6 OF THE CODE OF ORDINANCES REGARDING SPEED LIMITS ON CITY STREETS. City Administrator Kurt Ackermann advised this amendment was upon the recommendation of the City Attorney. The speed limits had previously been set by state law. The present ordinances specifies the speed limits in the city park and around the square, but did not specifiy what the speed was on other city streets. Mayor Cummings read the proposed ordinance heading as follows; AN ORDINANCE AMENDING SECTION 13-6 OF THE CODE OF ORDINANCES OF THE CITY OF STEPHENVILLE BY ADDING THERETO A PROVISION MAKING SPEED LIMIT OF MOTOR VEHICLES ON ANY STREET OF THE CITY THIRTY MILES PER HOUR UNLESS A DIFFERENT SPEED LIMIT HAS BEEN FIXED BY STATE REGULATION. After some discussion, Councilman Riggins moved, seconded by Councilman Irwin, that the City Council pass and approve an ordinance amending Section 13-6 of the, Code of Ordinances setting 30 m.:p.h. as the rate of speed on the city streets unles otherwise designated. Motion carried unanimously, ITEM VIII: RESOLUTION Wi thatheaaunanimous consent of the Council, Mayor Cummings appointed Mrs. Lillian Crow, Mrs. Helen Martin and Mr. Charles Gambel to the Board of Equalization and setting June 15, 1981 as the date of their first meeting. EXECUTIVE SESSION: Mayor Cummings adjourned the Open Meeting at 7:40 p.m. and ca e the Council into executive session as provided in the Open Meetings Act, Article 6252-17, Vernon's Texas Civil Statutes, Section 2(e), for the purpose of discussing pending or contemplated litigation. The Mayor and Council reconvened in open session at 8:10 p.m. Councilman Irwin moved, seconded by Councilman Riggins, that the City not pay the $58.00 court costs in the Wayne Barham tax suit. Motion carried unanimously. Councilman Irwin reported that the Committee recommends that the city owned property at the intersection of the Lingleville Road and FM 988 not be sold. There being no other business to come before the Council, the meeting adjourned at 8:10 p.m. ATTEST: _tJ "tyecretary 124A AN ORDINANCE AMENDING SECTION 13-6 OF THE CODE OF ORDINANCES OF THE CITY OF STEPHENVILLE BY ADDING THERETO A PROVISION MAKING SPEED LIMIT OF MOTOR VEHICLES ON ANY STREET OF THE CITY THIRTY MILES PER HOUR UNLESS A DIFFERENT SPEED LIMIT HAS BEEN FIXED BY STATE REGULATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: Section One Section 13-6 of the Code of Ordinances of the City of Stephenville is hereby amended to read as follows: Section 13-6. Speed limit in city generally and in city park, public square. (a) The term "motor vehicle," as used in this section, shall mean any automobile, truck, motorcycle, motor scooter or vehicle of any character which is propelled by a motor. (b) It shall be unlawful for any person to drive or operate any motor vehicle on any street within the corporate limits of the City of Stephenville at a greater rate of speed than thirty (30) miles per hour, unless a different speed limit has been fixed by State Regulations (c) It shall be unlawful for any person to drive or operate any motor vehicle in the city park at a greater rate of speed than fifteen (15) miles per hour. (d) It shall be unlawful for any person to drive or operate any motor vehicle on the public square in the city at a greater rate of speed than twenty (20) miles per hour. (e) Any person convicted of violating any of the provisions of this section shall, upon conviction thereof, be subject to a fine of not more than $200.00. Section Two This ordinance shall go into effect immediately from and after its passage and publication as provided by law. PASSED AND APPROVED this 2nd day of June, 1981. OY ATTEST: 693--U-yf ecretary
