HomeMy WebLinkAbout1982-08-03 - Regular City Councilffl MINUTES OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, HELD ON TUESDAY, AUGUST 3, 1982 - 7:00 P.M. The regular meeting of the City Council of the City of Stephenville, Texas, was called to order by the Mayor with the following member present: Mayor Joe F. Cummings Councilman G. A. Swindle Councilman William G. Brede Councilman Raymond Anderson and with the following members absent Riggins and Ray Reynolds. Councilman E. W. Ferguson Councilman David Clayton Councilmen John Pollan, Charles City Administrator Kurt J. Ackermann, City Attorney Joseph Chandler, Director of others were present. ✓ITEM I: APPROVAL OF MINUTES. Councilman Swindle moved approval of meetings of the 6th and 27th days of July, Brede made the second.. The motion carried AYES: All members present NOES: None ITEM 11: City Secretary Joyce Pemberton, Finance Charlene Young, and :he minutes from the City Council 1982, as written. Councilman by the following vote: REZONING LOTS 4.5.6.10.22.2 Mayor Cummings opened the floor for a public hearing to consider rezoning Lots 4,5,6,10,22,23, Block 145, City Addition, from R -1 to B -1, as recommended by the Planning & Zoning Commission. Mr. Harlan Huey and Mr. and Mrs. F. E. Caraway addressed the Council opposing said rezoning, They said they did want to keep their homes in a residential area. They also advised the Council they had not been notified of the Planning & Zoning Commission meeting in which this item was discussed. Mr. Royce Bays addressed the Council in favor of said rezoning. He said he already has B-1 zoning on two sides of his property and would like to see the whole block zoned B -1. Mr. Edd Brooks, owner of part of the property in question, addressed the Council stating that the persons he had contacted were in favor of the rezoning, but evidently there were some objections and whatever decision the Council made would be fine with him. Mr. Brooks did comment that the noise from any business that could go into a B -1 zoned area would not be any worse than the noise from the trucks on the South Loop. After discussion, Councilman Anderson moved that, due to the fact that the above homeowners are opposed to said rezoning, the City Council return this recommendation to the Planning & Zoning Commission so that all the proper requirements may be observed - - so that Mr. Huey and Mr. & Mrs. Caraway will be notified in due course and have the opportunity to meet with the Planning & Zoning Commission. The City Council will then consider their recommendations at that point. Councilman Brede made the second. The motion carried by the following vote: AYES: All members present NOES: None 21 "0 ITEM III: CONSIDER TRACTOR BIDS FOR STREET DEPARTMENT. Betty Chew presented the following bids for a tractor for the Street Department: 1. BRAMLETT IMPLEMENT, INC. P.O. Box 1197 Stephenville, TX John Deere Model 850 Tractor (22HP.) ------------ $5,936.25 John Deere Model 950 Tractor (27HP.)' ------------ $6,987.60 2. SANDERS TRACTOR SUPPLY 2721 W. Washington Stephenville, TX Long Model 360 Tractor (35 HP) ------------------ $7,400.00 3. ELLIS EQUIPMENT CO. 935 S.E. LOOP Stephenville, TX International Harvester Utility Tractor ,284 (30 HP). - - - -- $6,500.00 4. J.R.WALKER TRACTOR CO.. Rt, 1, Box 30B Stephenville, TX Kubota Tractor Model 1,245(Demo, 26.3 Hrs. New Warranty 25HP- $4,000.00 Kubota Tractor Model L235 (23.5 HP) ------------------ - - - - -- $5,500.00 Ford Tractor Model 1700 (25 HP).--------------------- - - - - -- $5,750.00 Mrs.. Chew advised the Council that Mr. Gann recommended that Bidder #3 (Ellis Equipment Co,) for $6500.00 be accepted if the Council would like to have a tractor with.the capabilities of having a front -end loader put on it at a later date. If the Council wants a tractor without the capability of adding a front -end loader, then Mr. Gann recommends Bidder #4 J. R. Walker Tractor Co,`s 3rd bid, Ford Tractor Model 1700 for $5,750.00. After some discussion, Councilman Anderson moved that the bid be awarded to J. R. Walker Tractor Co. on the Ford Tractor Model 1700 on low bid of $5,750.00. Councilman Clayton made the second. The motion carried by the following vote: AYES: All members present NOES: None ITEM IV: DISCUSSION OF POLICY REGARDING MAINTENANCE OF ALLEY WAYS Councilman Anderson advised the Council that some of the people in the Chamberlin Addition were unhappy about the alleys.(easements as there are no alleys in this addition). Some time ago the Council voted to do away with the city maintaining the easements due to the fact that the city's legal counsel advised that the city could not spend the taxpayers' money on maintenance of easements. Councilman Anderson said there was so much rain this year that the garbage trucks have really torn the easements up and these people really have a problem. One street in particular go so bad that the homeowners had to haul some rock in so that the garbage trucks could get through:. They are asking for help even though they know the city is not suppose to spend any money on the maintenance of easements. Councilman Clayton commented that the city has so many projects they are trying to get done with city crews and equipment without having to hire outside contractors. If the city starts trying to maintain the ease- ments again, which are not the city's to maintain, it puts the city in the situation of being "spread too thin" and costing too much money. 21'1 Councilman Swindle commented that he did not feel it would be fair to go up there and fix their easements when others all over town that are physically able are putting their garbage at curbside. Councilman Clayton commented that he felt it depends on how much the convenience of having their garbage picked up in the easements means to these persons at this point. If it means enough for them to fix the easement themselves that is well and good, but the city must treat one and all alike as best as it can. Councilman Swindle commented that, while on the subject of garbage, it would be well to admonish Mr. Bledsoe to get lids on all his dumpsters. Councilman Brede commented that there are a number of places around the city that do not have enough dumpsters. Councilman Swindle also commented that some of the dumpsters are placed too close to the curb and stick out into the street. This should also be corrected. There was no further discussion on this item and no action taken. Mayor Cummings did direct the City Administrator to contact Mr. Bledsoe and advise his that the city is standing by the agreement made and expect him to stay, to the letter, by his agreement. d I FROM CROSS TIMBERS F IL ON BAND SHELL Mrs. Connie Birdsong, president of the Cross Timbers Fine Arts Council, in a report to the Council, gave an update on the progress in building a bandshell in the city park. Mrs. Birdsong advised the Council of the suggestions made by Mr. Dave Neblin who was hired by the CTFAC to do a feasibility study on the bandshell. Mrs. Birdsong also advised the Council that $2,000.00 of the monies the CTFAC received from the Hotel -Motel Occupancy Tax was spent for free plays seen by over 4,000 children. Mrs. Birdsong also outlined activities for the coming year. After some discussion, it was the consensus of the Council to set August 11, 1982 at 1:30 p.m. as the date, time for a meeting in which the Council can take a final look at the FY 83 budget before the public hearing.
