OF THE
CITY OF STEPHENVILLE, HELD ON
THURSDAY, JUNE 19, 1986 - 10:00 A.M.
A called meeting of the City Council of the City of Stephenville,
Texas, was called to order by the Mayor with the following members
present:
Mayor: David Clayton
Councilmembers: Bob Self G.A.(Pinkie)Swindle
Larry Hammett Jim McSwain
Allen Horne Larry Tatum
Bill Brede
and with the following members absent: Ray Reynolds.
Others attending were City Administrator Kurt J. Ackermann, City
Secretary Joyce Pemberton, City Attorney Joseph A. Chandler, Chief of
Police Douglas Conner, Mr. Brit Ferguson, Mr. David Rosen, Mr. Marc
Richman, Mike Hall, Ted Helms, Sheriff David Coffee, Tom McWhorter,
Mike Perez, Ken Maltby, members of the press and others.
Mayor David Clayton called the Council into executive session for the
purpose of discussing personnel matters (on behalf of Brit Ferguson)
as provided in the Open Meetings Law, Vernon's Texas Civil Statutes,
Article 6252 -17, Paragraph 2(g).
Mr. Marc Richman, attorney for Mr. Brit Ferguson, stated that Mr. Brit
Ferguson requested an open hearing.
On the advice of City Attorney Chandler, the Mayor and City Council
agreed to an open hearing as requested.
Mr. Marc Richman, on behalf of Brit Ferguson, made his opening state-
ment outlining the reasons Mr. Ferguson should be reinstated with back
pay.
City Attorney Joseph Chandler made his opening statement outlining why
Mr. Brit Ferguson should have been dismissed for use of excessive
force in the arrest of a juvenile.
Mr. Chandler called Chief of Police Douglas Conner as his first wit -
ness. Mr. Chandler asked Chief Conner to state to the Council the
events that took place and the sequence of events in regard to this
hearing pertaining to dismissal of Officer Brit Ferguson.
Mr. Marc Richman questioned Chief Conner also.
Mayor David Clayton recessed the open hearing and called the Council
into executive session as provided in the Open Meetings Law, Vernon's
Texas Civil Statutes, Article 6252 -17, for the purpose of discussing
personnel matters.
Mayor David Clayton reconvened the Council into open session.
Mayor Clayton asked Mr. Richman to restate what he was asking for Mr.
Ferguson.
Mr. Richman stated he was asking that Mr. Brit Ferguson be reinstated
with back pay; clean his jacket up; let him be a police officer for
the City of Stephenville and mind his own business. He is not asking
for attorneys' fees nor any damages other than his back wages. At
this juncture, now, we would accept that and let everybody go their
own way without any other requests.
Mr. Chandler asked that Mr. Richman explain what he meant by "at this
juncture ". Mr. Richman said he meant that if it was settled at this
juncture we would not have to go further.

Councilman Pinkie Swindle moved that Mr. Brit Ferguson be reinstated
as a police officer with back pay to this point. Councilman Allen
Horne seconded the motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None
There being no other business to come before the Council, Mayor
Clayton adjourned the meeting at 11:35 a.m.
