OF THE
CITY OF STEPHENVILLE, HELD ON
FRIDAY, JULY 12, 1985 - 10:00 A.M.
A special meeting of the City Council of the City of Stephenville,
Texas, was called to order by the Mayor with the following members
present:
Mayor: David Clayton
Councilmembers: Bob Self G. A. Swindle (Late)
Larry Hammett Wm. G. Brede
Allen Horne Larry Tatum (Late)
and with the following members absent: James L. McSwain and Ray
Reynolds.
Also present were City Administrator Kurt J. Ackermann, City
Attorney Joseph Chandler, Director of Public Works Danny Johnson,
Building Inspector Gary Nabors, Planning & Inspections Coordinator
Betty Chew, members of the press, and others.
ITEM I: PUBLIC HEARING TO CONSIDER RECOMMENDATIONS FROM THE
PLANNING AND ZONING COMMISSION:
a. Favorable recommendation for rezoning of the
Tanglewood Northwest Subdivision:

(Neighborhood Business District).
Betty Chew, Planning & Inspections Coordinator, pre-
sented the staff reports on the rezoning requests
noting that all three had received favorable recommen-
dations from the Planning & Zoning Commission. It was
noted that rezoning was a requirement placed on the
Final Plat of the Tanglewood Northwest Subdivision.
The property owner of 563 N. Graham was requesting
rezoning for a "Bed and Breakfast" business.
The property owner of 562 N. Graham is operating a
"Day -Care Center" at that location and is requesting
rezoning so she may be allowed to continue her
business.
Mayor Clayton opened the floor for a public hearing to
consider the above three requests for rezoning.

There being no one present wishing to address the
Council on this issue, Mayor Clayton closed the public
hearing.
Councilman Hammett moved that:
Lots 8 thru 14, Block 2, Tanglewood Northwest Subdivision
Lots 16 thru 29, Block 3, Tanglewood Northwest Subdivision
Lots 1 thru 7, Block 6, Tanglewood Northwest Subdivision
Lots 1 thru 21, Block 7, Tanglewood Northwest Subdivision
be rezoned from R -1 "Single- Family Dwelling District"
to R -2 "One -Four Family Dwelling District ", and
Lot 1, Block 8, Tanglewood Northwest Subdivision
Lot 1, Block 9, Tanglewood Northwest Subdivision
Lot 1, Block 11, Tanglewood Northwest Subdivision
be rezoned from B -2 "Secondary & Highway Business
District" to B -1 "Neighborhood Business District ", and
Lots lA and 1B, Block 63, City Addition, known as 563
and 565 N. Graham Street, be rezoned from R -1
"Single- Family Dwelling District" to B -2 "Secondary &
Highway Business District" and
Lot 2A, Block 96, City Addition, known as 562 N.
Graham Street, be rezoned from R -1 "Single- Family
Dwelling District" to B -1 "Neighborhood Business
District ".
Councilman Horne seconded the motion. The motion
carried by the following vote:
AYES: Councilmen Self, Hammett, Brede, Horne,
Swindle, and Mayor Clayton.
NOES: None
ABSENT: Councilman Tatum.

SUBDIVISION
Director of Public Works Danny Johnson presented the
final plat of the Tanglewood Northwest Subdivision.
Mr. Johnson advised the Council that the recommended
changes made by the Planning & Zoning Commission and
City Council have been incorporated into the finale
plat. Mr. Johnson suggested the following changes be
made on the improvement plans of the Tanglewood
Northwest Subdivision:
1. Grading be put on the headwall at the park site.
2. Recommend 7 inch openings on inlet structures
instead of 6 inch openings.
3. Highway Department may require concrete protection
at discharge point of structures.
Councilman Hammett moved acceptance of the Final Plat
of the Tanglewood Northwest Subdivision as presented
with the recommended changes in the Improvement Plans
as requested by the City Staff. Councilman Swindle
seconded the motion. The motion carried by the
following vote:
AYES: Councilmen Self, Hammett, Brede, Horne,
Swindle, and Mayor Clayton.
NOES: None
ABSENT: Larry Tatum

ITEM III: COMMITTEE REPORT REGARDING KMN GARBAGE SERVICE RATE
REQUEST.
IV:
Councilman Horne, Chairman of the Franchise Committee,
reported that the Committee of Bill Brede, Ray
Reynolds, and himself had met and reviewed the books
of KMN Garbage Service. Councilman Horne stated that
the committee unanimously recommends that the Council
grant the rate increase from $4.25 to $5.00 per month
for residential garbage collection. Councilman Horne
further stated that KMN Garbage Service was planning
to add three trucks this year. They are not planning
to increase their commercial rates at this time as
their commercial rates are in line with other cities.
They do need some relief in the area of residential
rates.
Councilman Hammett moved to grant the request from KMN
Garbage Service for a residential collection rate
increase, from $4.25 to $5.00 per month, based on the
committee's report. Councilman Horne seconded the
motion. The motion carried by the following vote:
AYES: Councilmen Self, Hammett, Brede, Horne,
Swindle, Tatum, and Mayor Clayton.
NOES: None.

PURPOSE OF DISCUSSING THE PURCHASE OF REAL PROPERTY.
Mayor Clayton recessed the open meeting and called the
Council into executive session.
Mayor Clayton reconvened the Council into open
session.
Councilman Swindle moved to authorize Director of
Public Works Danny Johnson to negotiate for easements
on the South Transmission Line. Councilman Horne
seconded the motion. The motion carried by the
following vote:
AYES: Councilmen Self, Hammett, Brede, Horne,
Swindle, Tatum, and Mayor Clayton.
NOES: None
There being no other business to come before the Council, Mayor
Clayton adjourned the meeting at 11:25 a.m.

AN ORDINANCE REZONING THE LAND DESCRIBED FROM THE ZONING
CLASSIFICATION OF R -1 "SINGLE- FAMILY DWELLING DISTRICT" TO R -2
"ONE -FOUR FAMILY DWELLING DISTRICT ".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
That certain land in the City of Stephenville and being
Lots 8 thru 14, Block 2, Tanglewood Northwest Subdivision
Lots 16 thru 29, Block 3, Tanglewood Northwest Subdivision
Lots 1 thru 7, Block 6, Tanglewood Northwest Subdivision
Lots 1 thru 21, Block 7, Tanglewood Northwest Subdivision
and it is hereby rezoned and the zoning classification thereof is
hereby changed from the classification of R -1 "Single- Family
