City of Stephenville - City Council
TUESDAY, FEBRUARY 24, 2004 at 5:30 p.m.
The City Council of the City of Stephenville, Texas, convened on February 24, 2004, at 5:30
p.m., in the Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Special
Council Meeting, with the meeting being open to the public and notice of said meeting, giving the
date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government
Code, Vernon's Texas Codes Annotated, with the following members present, to wit:

The meeting of the Stephenville City Council was called to order at 6:03 p.m. on
Tuesday, February 24, 2004 by Mayor John Moser, who declared a quorum present.
IL EXECUTIVE SESSION. At 6:03 p.m., Mayor Moser recessed the open portion
of the meeting, and the council went into executive session in compliance with
the provisions of the Texas Open Meetings Law, Subchapter D, Government
Code, Vernon's Texas Codes, Annotated, in accordance with Sec. 551.074
Personnel Matters (a)(1) to deliberate the appointment, employment,
evaluation, reassignment, duties, discipline, or dismissal of a public officer or
employee and Sec. 551.071 Consultations with Attorney (2) on a matter in which
the duty of the attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly conflicts with
this chapter.

The council reconvened in open session at 6:37 p.m.
III. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION
(if necessary)
MOTION by Rusty Jergins, second by Robert Burns, to postpone the discussion or
action on the Fire Chief's position until otherwise directed by this council. MOTION
CARRIED by unanimous vote.
The council then deliberated the City Administrator's position. City Administrator,
Mike Castro exercised his right to have this matter discussed in open session.
Council member Joe Cude presented a proposal for Mike Castro, and asked if he
would be agreeable to being placed on administrative leave effective March 2, 2004,
and continuing until his employment contract expires on May 28, 2004. Cude further
added that Castro would vacate his office effective March 2, 2004, and would make
himself available in the event city staff or council had any questions.
Mike Castro responded by saying, "I am not in agreement with that. That's
unacceptable to me." He further stated, "I intend to fulfill all contractual obligations."
MOTION by Robert Burns, second by Bill Corbin, to appoint Mayor Moser, Mayor
Pro -Tem Jergins, and Personnel Committee Chairman Joe Cude as a committee to
discuss with the city administrator options concerning his contract. MOTION
CARRIED by unanimous vote.
Council member Richard Petronis announced that at this time, he does not intend to
seek re-election.
IV. ADJOURN
MOTION by Robert Burns, second by Rusty Jergins, to adjourn the meeting.
MOTION CARRIED by unanimous vote at 6:51 p.m.
