City of Stephenville - City Council
TUESDAY, NOVEMBER 2, 1993 - 7 :00 P.M.
The City Council of the City of Stephenville, Texas, convened in regular session
on November 2, 1993 at 7:00 p.m., in the Council Chambers at City Hall, 354 N.
Belknap, with the meeting being open to the public and notice of said meeting,
giving the date, time, place and subject thereof, having been posted as
prescribed by Article 6252 -17, Section 3A, V.T.C.S., with the following members
present, to wit:

I. CALL TO ORDER: Mayor Lavinia Lohrmann called the meeting to order and
declared a quorum present.
II. PRESENTATION OF EMPLOYEE SERVICE AWARDS.
Mayor Lohrmann presented watches and service awards to the employees
listed below.
Danny Johnson was presented with a Resolution of Appreciation and a
painting in recognition of 30 years of service to the City of Stephenville
Joyce Goodman 5 years Personnel Director
Dennis Connelly 10 years Water Department
Darvin Bridges 15 years Water Department
Danny Johnson 30 years Director of Utilities
III. PRESENTATION OF AUDIT ACHIEVEMENT AWARD.
Mark Kaiser, Director of Finance, was presented an Audit Achievement
Award from the Governmental Finance Officers' Association, as recognition
for excellence in the City's auditing report of 1992 -93.
IV. RESOLUTION OF APPRECIATION TO KMN GARBAGE SERVICE INC.
- Mayor Lohrmann presented Resolutions of Appreciation to KMN Garbage
Service, Inc. (Nicki Beth Jones, Meldeene Elliott and Karen Sue Johnson)
in recognition of their years of service to the City of Stephenville and
their help in the clean -up campaigns this year and years past.
V. CITY /COUNTY CONTRACTS.
City Attorney Randy Thomas advised that he did not have the city /county
contracts ready. Mr. Thomas said he had been meeting with County Attorney
Beth Barber and they were working on them and would have them completed
and approved by the County Commissiones by November 15th.
VI. CONSENT AGENDA:
Councilman Evans moved approval of the Consent Agenda as listed below.
Councilman Johnson seconded the motion. The motion carried UNANIMOUSLY
by a roll call vote.
A. APPROVAL OF MINUTES: October 5 and October 19, 1993.
B. BID CONSIDERATIONS:
1. Award Bids:
a. Senior Citizens Center Roof Repair.
2. Approve Specifications:
a. Heating & Air Conditioning @ City Hall.
C. PLANNING & ZONING COMMISSION RECOMMENDATIONS:
1. Approval of Site Development Plan for Lot 6A; Block 64; City
Addition.
VII. PUBLIC HEARINGS:
A. To Consider Rezoning 1600 Block of West Long St. and the 400 Block of
South Sixth St., from I" Industrial District" to R -3 "Multiple- Family
Residential District ".
Mayor Lohrmann opened the floor for a public hearing to consider
rezoning the 1600 block of West Long Street and the 400 block of South
Sixth Street from "I" Industrial District to 11R -3" Multiple - Family
District.
THOSE IN FAVOR OF REZONING:
Betty Hollifield addressed the Council on behalf of all the applicants
for this rezoning.
THOSE OPPOSED TO REZONING: None
There being no one else wishing to address this issue, Mayor Lohrmann
closed the public hearing.

VIII. ORDINANCES AND RESOLUTIONS:
A. Ordinance 1993 -33 - Rezoning the 1600 Block of West Long and the 400
Block of South Sixth, From I to R -3. pg. 24
Councilman Taylor moved approval of ORDINANCE NO. 1993 -33 REZONING THE
1600 BLOCK OF WEST LONG STREET AND THE 400 BLOCK OF SOUTH SIXTH STREET
FROM "I" INDUSTRIAL DISTRICT TO "R -3" MULTIPLE - FAMILY DISTRICT.
Councilman Zelman seconded the motion. The motion carried UNANIMOUSLY.
B. Ordinance No. 1993 -32 - Amending Ordinance No. 1993 -22 (Firearms Ord.)
Councilman Zelman moved approval of ORDINANCE NO. 1993 -32 AMENDING
ORDINANCE NO. 1993 -22 PROHIBITING THE DISCHARGE OF FIREARMS, INCLUDING
AIR GUNS, WITHIN THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE;

IX. CITY ADMINISTRATOR'S REPORT:
Don Davis, City Administrator, reminded the Council that one of the items
discussed during their retreat was to work on public relations and
marketing of the City. Several ways to do this was discussed. At the
last council meeting a video on Stephenville, prepared by the Chamber
of Commerce, was shown. In working with the Chamber and Harvey Davis,
who put the video together for the Chamber, we thought maybe this was a
way or avenue available to us to try to promote some of the issues of the
local government and some of the affairs that are going on in the com-
munity. Carroll Lee with Northland Cable Television very generously
offered free time to air some of the videos. We are going forward on an
experimental basis, with what we are calling "The Community Spotlight ",
using the Chamber film. This will start Sunday, November 7th, at 12 noon
and will be shown again on Wednesday, November 10th, at 5:45 pm. Then,
on Sunday, November 14th, at the same time, we're hoping to do our first
film on the Stephenville local govenment. Again, this is on an experi-
mental basis to see how it is received and, if it is something that we
feel is a good opportunity to "market" Stephenville, then, we'll try to
work an arrangement for an on -going thing for the course of the fiscal
year.
A special council meeting was set for Tuesday, November 23, 1993, at 5:30
pm.
X. CITY COUNCIUCITIZEN GENERAL DISCUSSION:
Councilman Wooley recognized the employees honored tonight.

ORDINANCE NO. 1993 -32
AN ORDINANCE AMENDING ORDINANCE NO. 1993 -22 PROHIBITING THE DISCHARGE OF
FIREARMS, INCLUDING AIR GUNS, WITHIN THE CORPORATE LIMITS OF THE CITY OF
STEPHENVILLE, ADDING TWO EXCEPTIONS TO SECTION 4: 4) PERSONS WHO WERE BORN
BEFORE SEPTEMBER 2, 1971, AND 5) PERSONS WHO HAVE SERVED IN THE UNITED STATES
ARMED FORCES; AND PROVIDING A PENALTY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
SECTION 1 - DEFINITIONS
1. Air Gun: An air rifle or air pistol of any description, by whatever name
known, that, by means of compressed air, compressed gas, springs, or any
other means capable of discharging and propelling shots, pellets or any
solid object for a distance of greater than fifty (50) feet.
2. Firearm: Any device designed, made, or adapted to expel a projectile
through a barrel by using the energy generated by an explosion or burning
substance or any device readily convertible to that use.
SECTION 2 - DISCHARGE OF FIREARMS PROHIBITED
It shall be unlawful for any person to discharge firearms of any kind or
description within the corporate limits of the City of Stephenville, Texas.
SECTION 3 - SHOOTING AIR GUN
It shall be unlawful for any person to shoot any air gun within the corporate
limits of the City of Stephenville, Texas.
SECTION 4 - EXCEPTIONS
1. Any person discharging a firearm in defense of person. (As defined in the
Texas Penal Code).
2. Police Officers or Animal Control Officers in the discharge of their duties.
3. Persons shooting air guns on private property who have completed a gun
safety course as approved by the Chief of Police.
4. Persons who were born before September 2, 1971.
5. Persons who have served in the United States Armed Forces.
SECTION 5 - PENALTY
Any person violating the provisions of this ordinance shall be deemed guilty of
a misdemeanor and upon conviction shall be fined any sum not less than $25.00,
nor more than $200.00 for each and every offense.

ORDINANCE NO. 1993 -33
AN ORDINANCE REZONING THE LAND DESCRIBED FROM THE ZONING CLASSIFICATION OF
I "INDUSTRIAL DISTRICT" TO R -3 "MULTIPLE- FAMILY RESIDENTIAL DISTRICT."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS:
That certain land in the City of Stephenville and being Lots 1, 2,
Part of Lot 3 and Part of Lot 4; Block 7; South Side Addition, Erath
County, Texas.
and it is hereby rezoned and the zoning classification thereof is hereby changed
from the classification of I "Industrial District" to R -3 "Multiple- Family
Residential District ". Said land is from this date zoned as R -3 "Multiple- Family
District, in accordance with the Zoning Ordinance of the City of Stephenville.
