The City Council of the City of Stephenville, Texas, convened in special session on Tuesday, October 19, 1999, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington Street, with the meeting being open to the public and notice of said meeting, giving the date, time, place and subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following members present, to wit: Mayor: Councilmembers: Absent: Others Attending: I. Stafford, City Secretary Randy Thomas, City Attorney Mayor John Moser called the special meeting of the Stephenville City Council to order at 5:30 p.m. on Tuesday, October 19, 1999. Mayor Moser declared a quorum present. II. NOMINATIONS COMMITTEE REPORT Council member Corbin gave this report, stating that the committee is recommending the Policy for Appointment to Boards and Commissions and a new council committee format. MOTION by Bill Corbin, seconded by Marshall Shelton, to approve the Policy for Appointment to Boards and Commissions, which is attached to these minutes. MOTION CARRIED by unanimous vote. III. MOTION by Bill Corbin, seconded by Marshall Shelton, to adopt for a trial period of six months, beginning November 1, 1999 and ending April 30, 1999, the change in the committee structure and format, which is attached hereto. MOTION CARRIED by unanimous vote. October 19, 1999 - Minutes of Special Meeting E IV. EXECUTIVE SESSION. . At 5:40 p.m., Mayor Moser recessed the open portion of the meeting and called the council into executive session in compliance with the provisions of the Texas Open Meetings Law, Subchapter D, Local Government Code, Vernon's Texas Codes, Annotated, in accordance with Sec. 551.072 Deliberate the purchase, exchange, lease, or value of real property and Sec. 551.074 Personnel Matters. V. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION (if necessary) MOTION by Rusty Jergins, seconded by Bill Corbin, to authorize the Mayor to execute a final settlement agreement with Erath Recycling, Inc. once it has been reviewed, approved, and finalized by legal counsel. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded by Marshall Shelton, to authorize the Mayor to execute a settlement agreement with Texas Natural Resources Conservation Commission, subject to the execution of the agreement with Erath Recycling, Inc. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded by Ed Horton, to authorize the city staff and legal counsel to draft and propose alternative supplemental environmental projects to the TNRCC. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded Ed Horton, to purchase for the sum of $37,160.00, Lot 2, Block 55, and Lots 7B 8, 9, 10, 11, 12, 13, Block 56, City Addition, Stephenville, Erath County, Texas, from the Daisy Jones Estate. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded by Bill Corbin, to authorize staff to negotiate for the exchange of property in the area of Blocks 55 and 56, City of Stephenville. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded by Marshall Shelton, to authorize staff to negotiate for the purchase of Lot 7, Block 132, City Addition, Stephenville, Erath County, Texas. MOTION CARRIED by unanimous vote. MOTION by Rusty Jergins, seconded by Bill Stanley, to authorize staff and the Personnel committee to re -work the evaluation forms of the City Administrator, City Secretary, and City Attorney. Motion carried by unanimous approval at 8:03 p.m. o Moset, Mayor ATTEST: j!4zk C�-- L., wj Cindy L a�rd, ity S tary October. 19, 1999 - Minutes of Special Meeting [i CITY OF STEPHENVILLE CITY COUNCIL POLICY FOR CITIZEN BOARDS AND COMMISSIONS Authority The Nomination Committee of the City Council shall administer the policies set forth herein, and the City Council shall have the ultimate authority relating thereto. Boards and Commissions The Nomination Committee shall recommend appointments for the following boards and commissions as vacancies occur: Planning and Zoning Commission Dangerous Buildings Abatement Board Board of Adjustment Electrical Board Building Board Mechanical Board Plumbing Board Parks and Recreation Advisory Board Airport Advisory Board Senior Citizens Advisory Board Fourth of July Fun Fair Committee Library Board Erath County Appraisal District Board of Directors Any other appointment as the Stephenville City Council may direct. Application Form and Procedure An application form shall be prescribed by the Nomination Committee of the City Council. Said application form shall include, but not be limited to, the following information: • Applicant's name, occupation, address, and telephone numbers; • A list of all City of Stephenville boards and commissions; • Previous experience and other information which the applicant may determine to be appropriate for application purposes. Policies for Boards and Commissions - Page 1 October 19, 1999 sm Applications shall remain on file in the City Secretary's office for a period of two years. Notice Notice of a vacancy on a board or commission shall be publicized in a newspaper of general circulation in Stephenville prior to the Nomination Committee's deliberation for appointments to said board or commission. The City Secretary shall cause to be published in said newspaper and, if available, broadcast over a local radio station(s), an announcement setting out general information about the vacancy. If possible, two weeks' notice shall be given of the committee's deliberation of an appointment. Written notice shall be given to board or commission member(s) prior to the expiration of that member's term. A board or commission member whose term is expiring may express a willingness to continue serving on said board or commission; however, this will not guarantee appointment. An incumbent board member shall not be required to complete and file an application form if that member wishes to be reconsidered for the same position. Term of Office The term of office shall be the length of time as prescribed in the ordinance or document creating said board or commission. A person shall not serve on more than one board or commission at the same time. The Nomination Committee shall determine the place number for each appointment at the time the appointment is made.
