City of Stephenville - City Council
TUESDAY, SEPTEMBER 21,1999 - 5:30 P.M.
The City Council of the City of Stephenville, Texas, convened in special session on Tuesday,
September 21, 1999, at 5:30 p.m., in the Council Chambers at City Hall, 298 West Washington
Street, with the meeting being open to the public and notice of said meeting, giving the date, time,
place and subject thereof, having been posted as prescribed by Chapter 551, Government Code,
Vernon's Texas Codes Annotated, with the following members present, to wit:

Mayor John Moser called the special meeting of the Stephenville City Council to
order at 5:30 p.m. on Tuesday, September 21, 1999. Mayor Moser declared a
quorum present.
H. STATUS REPORT ON THE ERATH COUNTY EVENTS CENTER BY
PETER FOX
Peter Fox made his presentation to the council. He reported that his group has been
looking at different factors and questions:
1. Is there a need for a facility such as this?
2. Why is there a need?
3. Would this facility meet the needs of the community?
4. Will this facility be utilized?
5. Will the facility be an integral part of a strategic plan?
6. Tourism aspect of the facility.
Fox's committee is looking at a site on the west side of Stephenville for a location.
An architect is doing some work on the design of the facility to present to the
committee.

Fox stated that he would like to have a representative from the council to serve on the
executive planning committee.
III. CONSIDER AN ORDINANCE LEVYING A TAX RATE FOR THE CITY OF
STEPHENVILLE, FOR THE TAX YEAR 1999
MOTION by Bea Marin, second by Rusty Jergins, to adopt Ordinance No. 1999 -26
levying a tax rate for the City of Stephenville for the tax year 1999. MOTION
CARRIED by unanimous vote.
IV. CONSIDER RELEASE OF EASEMENT FOR CLEAR ZONE APPROACH
AREA AT THE STEPHENVILLE AIRPORT
MOTION by Bea Marin, second by Barbara Terrell to authorize the Mayor to
execute a release of easement for a clear air easement for airport purposes. MOTION
CARRIED by unanimous vote.
V. CONSIDER ORDINANCE AMENDING 1998 -1999 BUDGET
MOTION by Marshall Shelton, second by Rusty Jergins, to adopt Ordinance No.
1999 -27, providing for budget amendments for the remainder of the fiscal year
beginning October 1, 1998 and ending September 30, 1999. MOTION CARRIED
by unanimous vote.
VI. CONSIDER AWARDING BIDS
A. Pickup
MOTION by Bill Corbin, second by Bea Marin, to award the bid for a one ton pickup
to Durant Chevrolet in the amount of $21,000.00. MOTION CARRIED by
unanimous vote.
B. City Hall Air Conditioner
MOTION by Bill Stanley, second by Bea Mann, to award the bid for three
replacement air conditioner units for City Hall to Cashons Air Conditioning, Inc. in
the amount of $8,055.00. MOTION CARRIED by unanimous vote.
VH. CONSIDER CANDIDATE SELECTION FOR THE BOARD OF TRUSTEES
OF THE TEXAS MUNICIPAL LEAGUE GROUP BENEFITS RISK POOL
MOTION by Barbara Terrell, second by Joel Hillin, to elect Tom Karsten, Council
member, City of Burleson, as candidate for TML Group Benefits Risk Pool Board
of Trustee, Region 8. MOTION CARRIED by unanimous vote.

VIII. EXECUTIVE SESSION. At 6:10 p.m., Mayor Moser recessed the open portion of
the meeting and called the council into executive session in compliance with the
provisions of the Texas Open Meetings Law, Subchapter D, Local Government
Code, Vernon's Texas Codes, Annotated, in accordance with Sec. 551.071
Consultations with Attorney.
A. Docket No. 1999- 0730- IHW -E; In the Matter of an Enforcement Action
against Erath Recycling, Inc.; S WR No. None; Enforcement ID No. 364
B. Potential Violations of Open Meetings Act
C. Claim of Mike and Cheryl Longley
IX. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION
At 7:57 p.m., Mayor Moser called the council back into open session.
MOTION by Barbara Terrell, second by Rusty Jergins to authority Mike Nasi of
Lloyd, Gosselink, Blevins, Richelle, Baldwin & Townsend, P.C. to submit a letter
of proposal to Erath Recycling under the terms and conditions discussed in executive
session. MOTION CARRIED by unanimous vote.
MOTION by Rusty Jergins, second by Marshall Shelton, to authorize the Mayor to
sign a letter to the Texas Attorney General under the guidance of the City Attorney
inquiring about open meetings, and any input from other council members should be
given to the mayor and city attorney by noon Tuesday, September 28. MOTION
CARRIED by unanimous vote.
X. ADJOURN
MOTION by Rusty Jergins, second by Bill Corbin, to adjourn the meeting. Motion
carried by unanimous approval at 8:0"

ORDINANCE NO. 1999-26
AN ORDINANCE LEVYING A TAX RATE FOR THE CITY OF STEPHENVILLE, FOR
THE TAX YEAR 1999.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
STEPHENVILLE, TEXAS:
That we, the City Council of the City of Stephenville, Texas, do hereby levy or adopt the tax
rate of $100.00 valuation for this city for tax year 1999, as follows:
$ .3359 for the purpose of maintenance and operation.
$ .1365 for the payment of principal and interest on bonds.
$ .4724 Total Tax Rate
The Tax Assessor /Collector is hereby authorized to assess and collect the taxes of the City
of Stephenville, Texas, employing the above tax rate.

REMAINDER OF THE FISCAL YEAR BEGINNING OCTOBER 1, 1998 AND
ENDING SEPTEMBER 30,1999.

the Stephenville City Hall.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF STEPHENVILLE, TEXAS:
SECTION 1. That the amended appropriations and anticipated revenues for the
fiscal year beginning October, 1998 and ending September 30,1999 for the support of the
general government of the City of Stephenville, Texas, be amended and fixed for the
remainder of the fiscal year ending September 30, 1999, with the revenues and
expenditures shown.
SECTION 2. That the amended budget is hereby approved in all respects and
adopted as the City's budget for the remainder of the fiscal year ending September 30,
1999.
