CITY OF STFPJENVILLE, TEXAS AND DECLARING AN MTERGFNCY MIFREAS, tire Gulf States 'Telephone Company has applied to the City Council of the City of Stephenville for an adjustment upwards of its rates for telephone service to meet its increased operating costs and to insure continued growth and expansion of the Stephenville Telephone Exchange to meet the needs of the cit- izens of Stephenvile and its trade territory, and WHEREAS, the Gulf States Telephone Company agrees to com- plete an additional- investment of in in the improvement and expansion of its Central Office and outside plant facilities, and WIIEREAS, after investigation by the City Council of all pertinent matters relating to the application, the adjustments applied for appear to be reasonable and just, NOW, THEREFORE, BE IT ORDAINED BY TIIECITY COUNCIL OF TILE CITY OF STEPIIENTVILLE, TEXAS: Section One That the Gulf States Telephone Company is authorized to place in effect, as hereinafter provided, the following rates for telephone service in the Stephenville Exchange, said rates not including applicable Federal Excise Taxes: CLASS OF SERVICE MONTHLY 'IATES BUSINESS: 1-Party Line, Handset 9.00 2-Party Line, Handset 7.75 Extension, IIandset 1.50 RESIDENCE: 1-Party line, handset 5.00 2-Party- Line, Handset 4.00 I -Party Line, IIandset 3.25 Extension, IIandset 1.00 Section Two That the said rates set out in Section One above shall take effect upon the furnishing of a certificate from an inde- pendent Certified Public Accountant by Gulf States Telephone Company to the City Council of Stephenville that an additional investment of :p30,000.00 in telephone facilities in the Stephenville Telephone Exchange has been completed; provided, however, that if such certification is furnished prior to April 1, 1958, such rates shall take effect on April 1, 1958. When said rates become effec- tive as herein provided, the rate schedule set out in Section One hereof shall supersede the schedule of rates set forth in Section Seven of the franchise ordinance relating to Gulf States Telephone Company passed and approved by the City of Stephenville on June 5, 1951, but no other provision of said ordinance of June 5, 1951 /ol shall be deemed to be modified, amended or, repealed hereby. Section Three No action which may be taken by Gulf States Telephone Company pursuant to this ordinance shall deprive the Gulf States Telephone Company of the right to earn a fair and reasonable return upon the fair value of its telephone plant, facilities and property in the Stephenville Exchange. Section Pour The fact that telephone service is a public necessity creates an emergency; therefore, all rules and regulations pro- viding for the reading of ordinances more than one time and/or on more than one occasion be, and they are hereby, suspended and this ordinance is passed and shall take effect as an emer- gency measure from and after its passage and approval.
