The City Council of the City of Stephenville, Texas, met in
regular session on April 7th, with Mayor J. W. Clements presiding
and the following aldermen present: Dan Lane, Dan Goodgame, Fredll
McCleskey, Doyle White, Chas. Neblett Jr., C. A. McDonald, and j
L. Riggins.
City election returns of April 7, 1942, were canvassed, and
on motion by Fred McCleskey, seconded by Doyle White, Mayor J. W.I
Clements and the following aldermen were declared elected: Two.
year term, C. R, Martin, Ward No. 1; Two year term, Bras J. Cole,j
Ward No. 2; Two year term, Reecie Jones, Ward No. 3; Two ya er
term, Leonard Fenner, Ward No. 4; and an unexpired term of one
year, T. R. Moore, Ward No. 2. The motion was carried.
Minutes of previous meetings were read and approved.
It was moved by L. Riggins, seconded by C. A. McDonald, that
Delia Wallace (colored) be placed on the charity water list. j

It was moved by Fred McCleskey, seconded by Dan Goodgame, th t

It was moved by C. A. McDonald, seconded by Dan Lane, that ;
the Fire Department boys not be allowed to pump water out of
cellars for the public. Motion carried.
It was moved by Chas. Neblett Jr., seconded by Doyle White,
that the following special summer rates be allowed for water:
I:
4,000 gallons minimum be allowed in the place of the regular;!
5,000 gallons minimum, for the months of June, July, August, and
September.
Applicable on request to domestic, or residential consumers
only, for the months of June, July, August, and September, who
use water for irrigation for trees, shrubs, flowers and grass,
20,000 gallons of water for $3.50 minimum, plus $.50 sewer charge}
For each 1,000 gallons above the 20,000 minimum used at the regulr
rate of $.25�, the City of Stephenville will furnish without char e
ad additional 1000 gallons of water.

Customers using this rate will, in the event of shortage of
supply, be immediately placed upon the regular rate upon notice
from the water department.
Bills and accounts were read, and on motion by C. A. McDonal,
seconded by Doyle White, were allowed and ordered paid.
It was moved by Chas. Neblett Jr., seconded by C. A. McDonald+
that the City Secretary notify the American Legion by letter that
the City cannot grant their request for aid and equipping the
Legion Hall. The motion was carried.
It was moved by Chas. Neblett Jr., seconded by Fred McCleskey'r
that the folding chairs be kept in the Recreation Hall at all timed,
and that they are not to be loaned on any occasion. Motion carrier.
It was moved by Dan Lane, seconded by Doyle White, that 0. B.
Sageser's salary be raised to $100.00 per month effective April 1.1
1942. Motion carried.
There being no further business, the Council stood adjourned
in an adjourned regular meeting, subject to the Mayorls call.

ATTENTION: Mr. Fred Wolfe, Commander
Gentlemen:
Acting on instructions from the City Council of
the City of Stephenville I hereby advise you that
after investigation of your request for aid in
discharging the indebtedness against and equipping
the Legion Mall in the City of Stephenville, that
it has been determined that City funds cannot be
applied to these purposes. At the regular meeting
of the City Council held on April 7, 19420 this
matter was formally acted upon. The members of
the City Council, as well as the other City offi-
oials, are strictly limited in the appropriation
and expenditure of municipal funds to debts and
expenses created for valid municipal purposes in
line with the lawful functions of the City govern-
ment, An expenditure of City funds for other than
City charges and expenditures creates a civil lie-
bility to an injunction suit restraining the use
of such funds for such outside purposes by any
taxpayer and can result in a criminal liability
for misapplication by the City officials of City
funds.
