AN ORDINANCE AUTHORIZING RANDY THOMAS, CITY ATTORNEY, TO FILE
PROCEEDINGS TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF
STEPHENVILLE AN EASEMENT FOR CONSTRUCTION, RECONSTRUCTION AND
MAINTENANCE OF A SANITARY SEWER LINE ON AND ACROSS A TRACT OR
PARCEL OF LAND SITUATED IN LOTS 3, 4 AND 6, BLOCK 72, CITY OF
STEPHENVILLE, IN ERATH COUNTY, TEXAS, AND A TRACT OR PARCEL OF
LAND SITUATED IN LOT 9, BLOCK 73, CITY OF STEPHENVILLE, IN
ERATH COUNTY, TEXAS, AND TO ACQUIRE AN ADDITIONAL TEMPORARY
CONSTRUCTION EASEMENT CONTIGUOUS TO THE PERMANENT EASEMENT
AGAINST CHARLES ROSS, THE OWNER OF SAID LAND, AND TO PROSECUTE
SAID CONDEMNATION PROCEEDINGS IN THE MANNER PRESCRIBED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
The City of Stephenville requiring an easement for public
purposes and having failed to agree with the owner upon the
damages and consideration to be paid and given to CHARLES ROSS,
the owner, for easement for sanitary sewer line on the
following described land:
Attached hereto as EXHIBIT "A"
RANDY THOMAS, City Attorney, is hereby authorized on
behalf of the City of Stephenville to file proceedings to
condemn the above described land for purposes of such easement
and to acquire an additional temporary construction easement
contiguous to the permanent easement such suit to be against
1Charles Ross, owner of said land and to prosecute condemnation
proceeding in the manner prescribed by law.

30' SANITARY SEWER EASEMENT

DESCRIPTION
PARCEL 8A:
BEING all that certain tract or parcel of land situated in Lots 3, 4, and 6, Block 72, City of
Stephenville, Texas, according to King's 1956 Map of the City of Stephenville, recorded in
Volume 381, Page 105 of the Deed Records of Erath County, Texas, said Lots being
described in deeds to Charles Ross recorded in Volume 229, Page 162, Volume 279, Page
291, and Volume 376, Page 559 of the Deed Records of Erath County, and being more
particularly described as follows:
BEGINNING at a point in the southeasterly line of Lot 6, being N 59°57'00" E, 170.95 feet
from southwesterly corner of said Lot;
THENCE N 14000'30" E, 244.97 feet to a point for corner;
THENCE N 17030'00" E, 585.56 feet to a point for corner;
THENCE N 51034'28" E, 6.98 feet to a point for corner on the northeasterly line of Lot 3;
THENCE S 30000'00" E, with said northeasterly line, 35.38 feet to a point for corner;
THENCE S 17030'00" W, 566.53 feet to a point for corner;
THENCE S 14000'30" W, 215.03 feet to a point for corner on the southeasterly line of Lot
6;
THENCE S 59°57'00" W, with said southeasterly line, 41.75 feet to the POI1 . _
BEGINNING and containing 24,304 square feet or 0.558 acres of land, more or less.

BEING all that certain tract or parcel of land situated in Lot 9, Block 73, City of
Stephenville, Texas, according to King's 1956 Map of the City of Stephenville, recorded in
Volume 381, Page 105 of the Deed Records of Erath County, Texas, said Lot being
described in deed to Charles Ross recorded in Volume 401, Page 526 of the Deed Records
of Erath County, and being more particularly described as follows:
BEGINNING at a point on the northwesterly line of said Lot 9, being N 59°57'00" E, 179.99
feet from the northwest corner of said Lot;
THENCE N 59057'00" E, with the northerly line of said Lot, 59.27 feet to a point for corner;
THENCE S 29032'33" W, 125.98 feet to a point in the centerline of a Branch;
THENCE N 88004'00" W, with said Branch centerline, 33.72 feet to a point for corner;
THENCE S 84009'00" W, with said Branch centerline, 0.13 feet to a point for corner;
r 1 THENCE N 29032'33" E, 90.54 feet to the POINT OF BEGINNING and containing 3,247
square feet or 0.075 acres of land, more or less.
Accompanying the above described 30 foot wide sanitary sewer easement are two (2) 35 foot
wide 'Temporary Construction Easements, said 35 foot wide Temporary Construction
Easements being parallel and contiguous to each side of the above described 30 foot wide
Sanitary Sewer Easement.
