AN ORDINANCE AUTHORIZING RANDY THOMAS, CITY ATTORNEY, TO FILE
PROCEEDINGS TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF
STEPHENVILLE AN EASEMENT FOR CONSTRUCTION, RECONSTRUCTION AND
^ MAINTENANCE OF A SANITARY SEWER LINE ON AND ACROSS A 140.33
( ACRE TRACT OF LAND OUT OF THE J. B. DUPUY SURVEY, IN ERATH
COUNTY, TEXAS, AND TO ACQUIRE AN ADDITIONAL TEMPORARY
CONSTRUCTION EASEMENT CONTIGUOUS TO THE PERMANENT EASEMENT
AGAINST ROBERT S. ELLIOTT, THE OWNER OF SAID LAND, AND TO
PROSECUTE SAID CONDEMNATION PROCEEDINGS IN THE MANNER
PRESCRIBED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
The City of Stephenville requiring an easement for public
purposes and having failed to agree with the owner upon the
damages and consideration to be paid and given to ROBERT S.
ELLIOTT, the owner, for easement for sanitary sewer line on the
following described land:
Attached hereto as EXHIBIT "A"
RANDY THOMAS, City Attorney, is hereby authorized on
behalf of the City of Stephenville to file proceedings to
condemn the above described land for purposes of such easement
and to acquire an additional temporary construction easement
contiguous to the permanent easement such suit to be against
Robert S. Elliott, owner of said land and to prosecute
condemnation proceeding in the manner prescribed by law.

30' SANITARY SEWER EASEMENT
PARCEL NO. 2
DESCRIPTION
BEING all that certain tract or parcel of land situated in the J. B. DUPUY SURVEY,
Abstract No. 196, in the City of Stephenville, Erath County, Texas, and being a part of a
140.33 acre tract of land described in deed to Robert S. Elliot, recorded in Volume 617,
Page 299 of the Deed Records of Erath County, Texas, and being more particularly
described as follows:
BEGINNING at a point in the fence line on the south line of said 140.33 acre tract, being
S 59°43' W, 147.18 feet from the southeast corner of said tract;
THENCE S 59°43' W, generally along a fence line and the south line of said tract, 113.00
feet to a point for corner;
THENCE N 73025' W, 360.27 feet to a point for corner;
THENCE S 85056' W, 296.13 feet to a point for corner;
THENCE N 78036' W, 704.52 feet to a point for corner;
THENCE N 64021' W, 491.56 feet to a point for corner;
THENCE N 38014' W, 766.11 feet to a point for corner in a fence line on the north line of
said tract;
THENCE N 61023' E, generally along a fence line and the north line of said tract, 30.39 feet
to a point for corner;
THENCE S 38014' E, 754.28 feet to a point for corner;
THENCE S 64021' E, 480.85 feet to a point for corner;
THENCE S 78036' E, 696.69 feet to a point for corner;
THENCE N 85056' E, 297.52 feet to a point for corner;
THENCE S 73025' E, 352.73 feet to a point for corner;
THENCE N 59043' E, 78.98 feet to a point for corner;
THENCE S 6404T E, 36.41 feet to the POINT OF BEGINNING and containing 1.857 acres
of land, more or less.
Accompanying the above described 30 foot wide sanitary sewer easement is a 70 foot wide
Temporary Construction Easement, said 70 foot wide Temporary Construction Easement
being parallel and contiguous to the southerly side of the above described 30 foot wide
Sanitary Sewer Easement.
