Dickens PropertyORDINANCE NO. 1992-23 AN ORDINANCE AUTHORIZING RANDY THOMAS, CITY ATTORNEY, TO FILE PROCEEDINGS TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF STEPHENVILLE AN EASEMENT FOR CONSTRUCTION, RECONSTRUCTION AND A MAINTENANCE OF A SANITARY SEWER LINE ON AND ACROSS A 14.40 ACRE ( 1 TRACT OF LAND AND A 9.00 ACRE TRACT OF LAND, BEING PARTS OF LOTS 1, 2, 3, AND 4, BLOCK 73, AND ALL OF LOTS 9 AND 10, BLOCK 72, IN ERATH COUNTY, TEXAS, AND TO ACQUIRE AN ADDITIONAL TEMPORARY CONSTRUCTION EASEMENT CONTIGUOUS TO THE PERMANENT EASEMENT AGAINST RONALD D. DICKENS, THE OWNER OF SAID LAND, AND TO PROSECUTE SAID CONDEMNATION PROCEEDINGS IN THE MANNER PRESCRIBED BY LAW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE: The City of Stephenville requiring an easement for public purposes and having failed to agree with the owner upon the damages and consideration to be paid and given to RONALD D. DICKENS, the owner, for easement for sanitary sewer line on the following described land: Attached hereto as EXHIBIT "A" RANDY THOMAS, City Attorney, is hereby authorized on behalf of the City of Stephenville to file proceedings to condemn the above described land for purposes of such easement and to acquire an additional temporary construction easement contiguous to the permanent easement such suit to be against Ronald D. Dickens, owner of said land and to prosecute condemnation proceeding in the manner prescribed by law. PASSED AND APPROVED this day of October, 1992. Dickens, recorded in Volume 813, Page 603 and Volume 812, Page 404 of the Deed Records of Erath County, Texas, and being more particularly described as follows: BEGINNING at a point in the Southwesterly line of said 9.0 acre tract, being N 87030'00" W, 37.86 feet from the most southerly corner of said tract; THENCE N 87030'00" W, 10.24 feet to a point for corner; THENCE N 80020'00" W, 37.84 feet to a point for comer; THENCE N 43012'26" W, 310.03 feet to a point for corner; THENCE S 31045'33" W, 180.30 feet to a point for corner, THENCE N 76007'35" W, 21.02 feet to a point for corner; THENCE N 31°45'33" E, 193.79 feet to a point for corner; THENCE N 16033'16" W, 254.95 feet to a point for corner; THENCE N 77°22'30" W, 482.50 feet to a point for corner; THENCE N 31032'06" W, 41.82 feet to a point for corner; THENCE S 77022'30" E, 494.88 feet to a point for corner; THENCE N 16033' 17" W, 594.03 feet to a point for corner; THENCE N 19057'01" E, 23.94 feet to a point for corner; THENCE N 83°20'34" E, 3.32 feet to a point for corner; THENCE S 88°52'26" E, 28.56 feet to a point for corner; THENCE S 19057'01" W, 24.00 feet to a point for corner; THENCE S 16033' 16" E, 869.90 feet to a point for corner; THENCE S 43°12'26" E, 358.37 feet to the point of beginning and containing 55,796 square feet or 1.281 acres of land, more or less. Accompanying the above described 30 foot wide sanitary sewer easement are two (2) 35 foot wide Temporary Construction Easements, said 35 foot wide Temporary Construction Easements being parallel and contiguous to each side of the above described 30 foot wide Sanitary Sewer Easement.
