Regular City Council Meeting
Tuesday, June 12, 2018 at 5:30 PM
The City Council of the City of Stephenville, Texas, convened on Tuesday, June 12, 2018, at 5:30 PM, in the
Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting,
with the meeting being open to the public and notice of said meeting, giving the date, time, place and
subject thereof, having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes
Annotated, with the following members present, to wit:

I. Call to Order
Mayor Svien called the meeting to order at 5:30 p.m.
II. Pledge of Allegiance
Council Member Mark McClinton led the pledge to the Texas and United States flags.
III. Invocation by Don Middleton, Cross Timbers Church of Christ
IV. Regular Agenda
1. Proclamation in Recognition of the 70th Anniversary of Jake and Dorothy's Cafe
Mayor Svien presented Kerry Roach with a key to the city and read the following
proclamation:
WHEREAS, Jake and Dorothy Roach opened their cafe on June 12, 1948; and
WHEREAS, Kerry Jane Roach, daughter of lake and Dorothy, owns and operates Jake and
Dorothy's Cafe today; and
WHEREAS, Jake Roach invented the waffle fry cutter, which the restaurant still uses for
their famous waffle fries; and
WHEREAS, Jake and Dorothy's Cafe has been featured on Texas Country Reporter (2012),
The Day Tripper (2010), and Texas Highways magazine (2013);
WHEREAS, Jake and Dorothy's Cafe was named among Texas Monthly's "40 Best Small
Town Cafes" in December 2008; and
WHEREAS, Jake and Dorothy Roach embraced the entrepreneurial spirit and also opened
^ 1&D Golf Land, which is celebrating its 50th Anniversary this year; and
jj WHEREAS, lake and Dorothy's Cafe has been serving Thanksgiving meals every year since
its opening; and
WHEREAS, Jake and Dorothy's Cafe has been a Stephenville Institution for 70 years.
NOW, THEREFORE, I, Doug Svien, Mayor of the City of Stephenville, on behalf of the City
Council and the citizens of Stephenville, do hereby declare June 10 — 17, 2018 Jake and
Dorothy's Week and encourage all citizens of the City of Stephenville and Erath County to
join us in celebrating 70 years of Chicken -Fried Greatness!
2. Citizens' General Discussion
Marion Cole addressed the council regarding the third annual Sundown on the Square,
which will take place on Saturday, October 13 from 5 p.m. until 9 p.m., with a free concert
featuring Asleep at the Wheel. Bygone Days on the Bosque will take place the same day
from 10 a.m. to 3 p.m. at the Stephenville Historical House Museum. All proceeds will
benefit the museum and their restoration efforts. Ms. Cole explained the sponsorship
opportunities available; Mayor Svien stated that he and Councilmember Pendleton would
be making a sponsorship donation and challenged the rest of the council to do so as well.
3. Citizen Budget Requests
No one came forward with budget requests.
4. Consider Approval of Ordinance No. 2018-0-18 Regulating Credit Access Businesses
This item was tabled at the May 1, 2018 meeting.
j I MOTION by Brady Pendleton, second by Mark McClinton, to remove Ordinance No. 2018-
0-18 Regulating Credit Access Businesses from the table.
MOTION CARRIED by unanimous vote.
Chief Jason King reviewed the ordinance with council. Changes were made regarding
minimum distance between businesses, the application fee, and the yearly registration
fee as was discussed on May 1.
MOTION by Mark McClinton, second by Alan Nix, to approve Ordinance No. 2018-0-18
Regulating Credit Access Businesses.
MOTION CARRIED by unanimous vote.
5. Discuss City Council Place 3 Vacancy
Council member Mark McClinton stated that he felt that council appointments were
solely in the purview of the voter and potential council members should not be appointed
by sitting council members. Council member Nix stated that appointments had been
made in past when similar situations had occurred. Mayor Svien reminded council
that a measure to reduce the size of the city council will be on the November
ballot, and it would be logical to wait until after the election.
MOTION by Carla Trussell, second by Sherry Zachery, to leave Place 3 vacant until the May
2019 General Election.
MOTION CARRIED by unanimous vote.

V. Council Appointments
1. Consider Creation of Tourism and Visitor Committee
MOTION by Brady Pendleton, second by Sherry Zachery, to create a special council
committee comprised of three council members to oversee the Tourism and Visitors
Bureau and to consider HOT fund applications not to exceed $5,000.
Mr. Nix asked why the dollar amount was included in the motion. Mr. Barnes explained
that the committee would act like any other committee and simply bring
recommendations to full council, therefore a maximum was not necessarily needed. Mr.
Pendleton agreed and amended the motion.
MOTION AMENDED by Brady Pendleton, second by Mark McClinton, to amend the
motion by striking $5,000. MOTION CARRIED by unanimous vote
MOTION by Brady Pendleton, second by Sherry Zachery, to create a Tourism and Visitors
Bureau committee comprised of three council members to oversee the Tourism
department and make recommendations to full council on matters pertaining to the
Tourism and Visitors Bureau.
MOTION CARRIED by unanimous vote.
2. Consider Approval of Council Committee Assignments
Mayor Svien made the following recommendations for council committees:
Community Services: Sherry Zachery, Chair; Mark McClinton, Carla Trussell,
Brandon Huckabee
Finance: Mark McClinton, Chair; Carla Trussell, Brady Pendleton
Nominations: Rhett Harrison, Chair; Carla Trussell, Alan Nix, Sherry Zachery
Personnel: Sherry Zachery, Chair; Alan Nix, Brandon Huckabee
Planning/Development: Brandon Huckabee, Chair; Mark McClinton, Brady
Pendleton, Rhett Harrison
Public Health and Safety: Brady Pendleton, Chair; Rhett Harrison, Alan Nix
Public Works: Alan Nix, Chair; Mark McClinton, Rhett Harrison, Brandon Huckabee
Tourism/Visitors: Carla Trussell, Chair; Brady Pendleton, Sherry Zachery
Council Member Nix requested that the recommendations be handed out prior to the
meeting in the future so that members would have time to review them prior to approval.
Mayor Svien acknowledged Mr. Nix's request.
MOTION by Mark McClinton, second by Carla Trussell, to approve council committee
assignments as presented.
MOTION CARRIED by unanimous vote.
3. Consider Appointing a Representative to the North Central Texas Council of
Governments
MOTION by Sherry Zachery, second by Rhett Harrison, to appoint Carla Trussell as the
city's representative to the North Central Texas Council of Governments.
MOTION CARRIED by unanimous vote.

VI. Planning and Zoning Commission
1. PUBLIC HEARING
Case No. SUP2018-001: Boyd Waggoner, applicant, is requesting a Special Use Permit in
order to operate a "Restaurant with Alcoholic Beverage Service" in the Downtown
District, at 389 South Graham, being Lot 12, Block 4, of the City Addition to the City of
Stephenville, Erath County, Texas.
Mayor Svien opened the public hearing at 6:10 p.m.
Boyd Waggoner, applicant, came forward to speak in favor of the Special Use Permit. Mr.
Waggoner stated that he is excited to get the restaurant open.
No one came forward to speak in opposition to the Special Use Permit.
Mayor Svien closed the public hearing at 6:14 p.m.
2. Consider Approval of Ordinance No. 2018-0-21 Granting a Special Use Permit in order
to operate a "Restaurant with Alcoholic Beverage Service" in the Downtown District, at
389 Graham, being Lot 12, Block 4, of the City Addition to the City of Stephenville, Erath
County, Texas.
MOTION by Brady Pendleton, second by Mark McClinton, to approve a Special Use Permit
in the Downtown District for a restaurant with alcohol sales at 389 South Graham.
MOTION CARRIED by the following votes:
Ayes: Mark McClinton, Carla Trussell, Brady Pendleton, Rhett Harrison,
Sherry Zachery, and Brandon Huckabee
Noes: Alan Nix
3. PUBLIC HEARING
Case No. ZA: 2018-001:Consider Amending Section 5.4 of the Zoning Ordinance: Single -
Family Residential District R-1.5
SAM Height, Area, Yard and Lot Coverage Requirements.
(1) Minimum lot area from 6,000 square ft. to 5,000 square ft.
(2) Minimum lot width and lot frontage: 60 feet to 50 feet.
Mayor Svien opened the public hearing at 6:16 p.m.
No one came forward to speak in favor of, or opposition to, the amendment.
4. Consider Approval of Ordinance No. 2018-0-22 Amending Section 5.4 of the Zoning
Ordinance
MOTION by Mark McClinton, second by Carla Trussell, to approve Ordinance No. 2018-0-
22 amending section 5.4 of the zoning ordinance.
MOTION CARRIED by unanimous vote.
VII. MONTHLY BUDGET REPORT
1. Financial Report for the Period Ending April 30, 2018
Monica Harris, Director of Finance, gave the following report:
In reviewing the financial statements ending April 30, 2018, the financial
indicators are as good or better than expected.

City Council - 12 Jun 2019
• Property Tax - We received $19K in property taxes in the month of April, resulting
in a $513K increase over funds collected through April 30th of last year. Erath
County normally collects 97.22% of the property taxes for Stephenville through
April; the amount collected this year is 98.67%of budget.
• Sales Tax - We received $403K in sales tax in April, resulting in $80K over the
target budget through April 30th. We have received $77K or 2.29% more than
last year.
• Revenue (Budgetary comparison) - The target budget for operating revenue is
$13.9 million. We received $16.4 million in revenue, resulting in $2.5 million over
budget. This is a result of property taxes, which are billed in October and due by
January 31st, as well as sales and other taxes.
• Expenditures (Budgetary comparison) - The target budget for operating
expenditures is $11.3 million. We expended $10.1 million, resulting in $1.2
million under budget.
• Revenue (Prior year comparison) - Operating revenue received last year was
$15.9 million as compared to the current year's $16.4 million, resulting in a $459K
increase due to property taxes and sales taxes.
• Expenditures (Prior year comparison) - Operating expenditures last year were
$10.3 million as compared to the current year's $10.1 million, resulting in a $228K
decrease.
• New Programs - The concrete work under the bleachers at the City Park has been
completed. The Mobile Command has been ordered for EMS, and the three
Patrol vehicles have been ordered and are being equipped. $20,017 of the
$875,000 for street pavement maintenance has been spent as of April 30th.
VIII. Stephenville Type B Economic Development Authority Update
Ashleigh Feuerbacher, Director of Marketing and Administration, gave the following report:
Jeff Sandford, the new SEDA Director, began June 1. He is currently travelling back and forth from
North Carolina as he prepares his family for the move to Stephenville. He and Ms. Feuerbacher
have a standing 9:00 a.m. call every day to check in and keep on top of SEDA business until he is
here permanently.
The SEDA Board and Mr. Sandford are currently working on the 2018-2019 budget.
Mr. Sandford is currently drafting a personnel policy and procedure manual, which is set to be
sent to the board for review in August. Procedures regarding project applications and general
office processes is also being developed.
Project Updates:
Project Blue - The application to the Texas Capital Fund will be submitted July 20.
Project Pine Floor - The project is progressing and more information will be shared with council
soon.
Project SRS - This is a retail development that will be coming soon. They are currently in real
estate negotiations.
Project HT - The real estate developer for this project has been working with the city to ensure
that everything is in order to move forward with the project.

The West Washington Sewer Extension agreement is ready and will be signed in the near

`[ jl Christy Plaza Traffic Signal - TXDOT has confirmed that the plans have been sent to the
site engineers and there are no issues or concerns.
Facade Grant
Two businesses, Singleton Realty and Skinny's Phone Repair, have applied and were
approved for a facade grant.
Inquiries and Interest
Medical Development - This has been put on hold by their corporate office while they
handle issues with another project

Allen Barnes, City Administrator, requested that Item No. 4 - Consider Approval of the City
of Stephenville Mission, Vision, and Core Values - be removed from the consent agenda
for further discussion.
MOTION by Brady Pendleton, second by Mark McClinton, to approve the consent agenda
with the removal of Item No. 4.
MOTION CARRIED by unanimous vote.
Mr. Barnes stated that city staff had met to revamp the city's mission, vision, and core
values. An "Innovation Team" was created to accomplish this and provide more direct
employee input. The Innovation Team proposed the following:

Mr. Barnes announced that the Shappard Street Project was awarded the state -level award from
the American Public Works Association, along with a nomination for the national award.
XI. Comments by Council Members
Council Member Mark McClinton gave kudos to the partnership between the city and Tarleton to
accomplish the brick paving of Shappard Street. He also encouraged everyone to attend the
Stephenville Fire Fighter's Association's Fire Ops 101 event - it is a great program; and a big "thank
you" to those who put it on. He also wanted to recognize Walmart for their donation to the
Senior Citizens Center and thanked the local associates for the nomination. He thanked Sandy
Morgan for keeping the center running smoothly.
Council Member Carla Trussell thanked the Public Works staff for taking initiative to apply for the
APWA award. She encouraged everyone to participate in the Fourth of July activities coming up.
Council Member Alan Nix thanked Brady Pendleton for setting the bar high at the special meeting
on Tuesday, June 5 with a record -breaking two minute meeting.

showing him city facilities and giving him an introduction into the day-to-day operation of the city.
Doug Svien wanted to thank the community for their support of the first annual Mayor's Breakfast
which raised over $14,000 for the local Boy Scouts.
