AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS, CANVASSING AND
CERTIFYING THE ELECTION RETURNS, INCLUDING THE RETURNS OF EARLY VOTING BALLOTS CAST IN
CONNECTION WITH THE GENERAL AND SPECIAL ELECTION HELD ON SATURDAY, MAY 9, 2015, TO
ELECT FOUR COUNCIL MEMBERS TO TWO-YEAR TERMS OF OFFICE; AND TO CONSIDER A JOINT BALLOT
PROPOSITION ON WHETHER TO REDUCE THE ADDITIONAL SALES TAX FOR PROPERTY TAX RELIEF BY
THE RATE OF ONE -EIGHTH (1/8TR) OF ONE PERCENT TO ADOPT THE TYPE B ECONOMIC DEVELOPMENT
SALES AND USE TAX AT THE RATE OF ONE -EIGHTH (1/8T") OF ONE PERCENT; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR SAID ORDINANCE TO TAKE EFFECT FROM AND AFTER ITS
DATE OF PUBLICATION.
WHEREAS, on May 9, 2015, an election was held in the City of Stephenville, Texas, for the following
purposes: (1) to elect four (4) council members to two-year terms of office; and (2) to consider a joint ballot
proposition on whether to reduce the additional sales tax for property tax relief by the rate of one -eighth
(1/8th) of one percent to adopt the Type B economic development sales tax at the rate of one -eighth (1/8th)
of one percent; and
WHEREAS, the official returns, including returns of early voting ballots cast, of the presiding judges
of the General and Special Election, have been presented and delivered; and the City Council acting in
capacity as the Canvassing Board and has duly canvassed said returns in accordance with the law; and
WHEREAS, the returns of the Special Election, including the returns of the early voting ballots, duly
and legally made, determined the ballot proposition on the reduction of the additional sales tax for property
tax relief by the rate of one -eighth (1/8th) of one percent to adopt the Type B economic development sales
tax at the rate of one -eighth (1/8th) of one percent received the following votes:

"Shall the City Council of the City of Stephenville be authorized to reduce
the additional sales tax for property tax relief within the City at the rate
of one -eighth of one percent to adopt the Type B economic development
sales and use tax within the City at the rate of one -eighth of one
percent, to undertake projects authorized by chapters 501 to 505 of the
Texas Local Government Code, as amended, including but not limited to:
land, buildings, equipment, facilities, expenditures, targeted
Infrastructure, and improvements to promote new or expanded business
development; expenditures required or suitable for infrastructure
necessary to promote or develop new or expanded business enterprises;
job training required or suitable for the promotion of development and
expansion of business enterprises; land, buildings, equipment, facilities,
and improvements required or suitable for use for professional and
amateur sports, including children's sports, athletic, entertainment,
tourist, convention, and public park purposes and events; and the
maintenance and operations expenses for any of the above described
projects?"

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE,
TEXAS:
Section 1. FINDINGS INCORPORATED
The findings set forth above are incorporated into the body of this Ordinance as if fully set forth
herein.
Section 2. That the City Council officially finds and determines an election was duly order to be
held in the City of Stephenville, Texas, on the 91" day of May, 2015, for the following
purposes:
(a) to elect four (4) Council members to two (2) year terms of office; and
(b) Consider the reduction of the additional sales tax for property tax relief by the rate of
one -eighth (1/8th) of one percent to adopt the Type B economic development sales tax
at the rate of one -eighth (1/8th) of one percent.
Section 3. That the City Council of Stephenville, Texas, officially finds and determines that only
residents of the City of Stephenville were allowed to cast votes at said election.
Section 4. That pursuant to the applicable provisions of the Texas Local Government Code, and the
Texas Election Code, the City Council of the City of Stephenville, Texas, officially finds
and determines and declares the results of said election to be that:
(a) Mark McClinton is hereby elected to a two-year term to City Council, Place 1;

(b) Doug Svien is hereby elected to a two-year term to City Council, Place 3;
(c) Rhett Harrison is hereby elected to a two-year term to City Council, Place 5;
(d) Sherry Zachery is hereby elected to a two-year term to City Council, Place 7;
(e) the additional sales tax for property tax relief is reduced by one -eighth (1/8th) of one
percent from one-half of one -percent (0.50%) to three -eighths (3/8ths) of one percent
(0.375%), and the Type B economic development sales tax is adopted at the rate of one -
eighth (1/8th) of one percent (0.125%).
Section 5. That the Mayor is hereby authorized and directed to execute and deliver Certificates of
Election to the successful candidates elected at the General Election, as specified in
Section 4 of this Ordinance.
Section 6. That the Mayor is hereby authorized and directed to execute and deliver the Canvass of
the General and Special Election in accordance with the election laws of the State of
Texas, and to take all other action necessary in connection therewith.
Section 7. That the City Secretary of the City of Stephenville, Texas, is hereby authorized and
directed to publish this Ordinance, or its caption in one issue of the official City
newspaper as required by Section 52.001 of the Texas Local Government Code.
Section S. That the City Secretary of the City of Stephenville, Texas, is hereby authorized and
directed pursuant to Section 321.405 of the Texas Tax Code to send by certified or
registered mail to the State Comptrollers office a certified copy of this Ordinance along
with a map of the City of Stephenville clearly showing its boundaries.
Section 9. That this Ordinance shall take effect from an after its date of passage in accordance with
law, and it is so ordained.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Stephenville, Texas, on this
the 12tn day of May, 2015.
