City of Stephenville —City Council
TUESDAY, SEPTEMBER 17, 1996 - 5:30 P.M.
The City Council of the City of Stephenville, Texas, convened in special session on September 17,
1996, at 5:30 p.m., in the Council Chambers at City Hall, 354 N. Belknap Street, with the meeting
being open to the public and notice of said meeting, giving the date, time, place and subject thereof,
having been posted as prescribed by Chapter 551, Government Code, Vernon's Texas Codes
Annotated, with the following members present, to wit:
Mayor John Pollan
Councilmembers: Jerry B. Madkins
Marshall Shelton
Joel Hillin
K. H. Conatser
Billy Bob Hodges
Scott Evans
Bill Corbin
Absent: Barbara Terrell
Others Attending Don Davis, City Administrator
Cindy L. Stafford, City Secretary
Randy Thomas, City Attorney
I. CALL TO ORDER
Mayor Pollan called the meeting to order at 5:30 p.m. and declared a quorum present.
He CONSIDER AN ORDINANCE LEVYING A TAX RATE FOR THE CITY OF
STEPHENVILLE FOR THE TAX YEAR 1996
Councilmember Evans made the motion to approve Ordinance No. 1996-27, which
was seconded by Councilmember Corbin. The motion passed by unanimous vote.
III. CONSIDER ADOPTING THE FINAL MASTER PLAN FOR CITY PARK
Councilmember Shelton moved to adopt the Master Plan for City Park. The motion
was seconded by Councilmember Conatser and passed by unanimous vote.

IV. CONSIDER AUTHORIZATION OF PREPARATION OF GRANT
APPLICATION TO TEXAS PARKS AND WILDLIFE DEPARTMENT
Councilmember Hillin moved to authorize Schrickel, Rollins to begin work on the
grant application to the Texas Parks and Wildlife Department. The motion was
seconded by Councilmember Hodges and passed by unanimous vote.
V. CONSIDER THE APPROVAL OF BUDGET AMENDMENTS
Councilmember Cofiatser moved to adopt Ordinance No. 1996-28. The motion was
seconded by Councilmember Shelton and passed by unanimous vote.
VI. CONSIDER AWARDING BID FOR CITY DEPOSITORY CONTRACT
Councilmember Hillin moved to award the bid for City Depository Contract to
Stephenville Bank and Trust Co. The motion was seconded by Councilmember
Hodges and passed by unanimous vote.
VII. EXECUTIVE SESSION. At 5:37 p.m., Mayor Pollan recessed the open portion of
this meeting, and the Council went into executive session in compliance with the
provisions of the Texas Open Meetings Act, Subchapter D., § 5 51.071(1)(A), Local
Government Code, Vernon's Annotated Civil Statutes, in accordance with the
authority contained in Consultation with Attorney; Closed Meeting; pending or
contemplated litigation.
A. Texas Parks & Wildlife Department, et al v. Texas Water Commission, et al;
Cause No. 432,066; In the 98th Judicial District Court, Travis County, Texas
B. Bob LeFevre and Weldon Wilson v. City of Stephenville
C. Erath County Grand Jury Investigation
Mayor Pollan recessed the Executive Session at 7:15 p.m. and called the Council back
into open session.
VIII. ACTION TAKEN ON MATTERS DISCUSSED IN EXECUTIVE SESSION
(if necessary)
Councilmember Evans made the motion to authorize the law firm of Haynes and
Boone to negotiate a settlement offer with Bob LeFevre and Weldon Wilson.
Councilmember Hodges seconded the motion which passed by unanimous vote.

Councilmember Corbin made the motion to retain the services of Robert J. Glasgow
to represent the city employees (Don Davis, Mark Kaiser, Ronnie Isham, and Brenda
Kelley) during the Grand Jury hearings scheduled to begin on September 23, 1996.
Councilmember Madkins seconded the motion. Councilmember Conatser requested
a roll call vote. The motion passed by the following vote:
AYES: Councilmembers Madkins, Shelton, Hillin, Evans, Hodges,
and Corbin, and Mayor Pollan.
NOES: None
ABSTAINING: Conatser
There being no other business to come before the Council at this time, Mayor Pollan
adjourned the meeting at 7 :17 p.m.
