ORDINANCE AUTHORIZING MAYOR PRO-TEM ALLEN HORNE TO EXECUTE ON
BEHALF OF THE CITY OF STEPHENVILLE A RIGHT-OF-WAY EASEMENT TO
TEXAS POWER AND LIGHT COMPANY FOR AN ELECTRIC SUPPLY LINE UPON
AND ACROSS LAND OWNED BY THE CITY OF STEPHENVILLE GRANTING THE
RIGHT TO ERECT FOUR POLES AND FOUR SINGLE OR MULTIPLE GUY
ANCHORAGES ALONG THE COURSE OF SAID LINE TOGETHER WITH RIGHT OF
INGRESS AND EGRESS FOR CONSTRUCTING, IMPROVING, INSPECTING,
MAINTAINING, OPERATING AND REMOVING SAID LINE AND
APPURTENANCES, THE RIGHT TO CUT AWAY AND CLEAR TREES AND OTHER
OBSTRUCTIONS WHICH MAY ENDANGER OR INTERFERE WITH THE PROPERTY
MAINTENANCE AND OPERATION OF SAID LINE TO REMAIN IN EFFECT
UNTIL SAID LINE SHALL BE ABANDONED.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
Allen Horne, Mayor Pro-Tem of the City of Stephenville, is
hereby authorized to execute r ight-of -way easement on behalf of
the City to Texas Power and Light Company, granting and convey-
ing to Texas Power and Light Company an easement for the con-
struction of an electric supply line consisting of variable
number of wires and circuits, and all necessary or desirable
appurtenances; over, across and upon City's land in the John
Blair Survey, Erath County, Texas, described as follows:
Said right of way granted being 20 feet wide, being 10
feet on each side of the center line thereof, the courses
and distances of said center line of said right of way
being as follows, to -wit:
BEGINNING at an existing TU Electric pole located on
Grantor's property. Said point being located 22.11 feet
in a northerly direction along the west right-of-way line
of FM Highway No. 988 with a curve to the left whose
radius is 1,372.40 feet and whose central angle is 40 55'
50.8" and 1 foot N 300 W of Grantor's southwest property
corner. Said southeast property corner being the inter-
section of Grantor's south property line and the west
right of way line of FM Highway No. 988;
THENCE N 300 W for a distance of 9 feet to an angle point;
THENCE N 230 15' E, for a distance of 90 feet to an angle
point;
THENCE N 220 45' W, for a distance of 35 feet to a point;
Said point hereinafter referred to as Point "A"•
THENCE S 280 55' E, for a distance of 30 feet to a point;
BEGINNING again at aforementioned Point "A";
THENCE N 280 55' W, a distance of 223 feet to an angle
point;
THENCE N 510 07' W, a distance of 254 feet to a point.
Grantee shall have the right to erect four poles and four
single or multiple guy anchorages along the course of said
line, together with the right of ingress and agress for the
purpose of constructing, improving, inspecting, maintaining,
operating and removing said line and appurtenances; with
Grantee to have the right to relocate said line that may be
adjacent to any road if and when the road is widened in the
future and the right to cut away and keep clear of said line
and appurtenances all trees and other obstructions which, in
the judgment of Grantee, may endanger or interfere with the
proper maintenance and operation of said line with Grantor to
not make any changes in the grade, elevation or contour of the
land or make any construction or improvements on the land which
will interfere with the rights granted to Grantee unless City
shall obtain the prior written consent of Grantee; with said
easement to remain in effect until said line shall be
abandoned.
