AN ORDINANCE AUTHORIZING JOSEPH A.CHANDLER AND RANDY THOMAS,
ATTORNEYS FOR THE CITY OF STEPHENVILLE, TO FILE PROCEEDINGS
TO CONDEMN AND ACQUIRE ON BEHALF OF THE CITY OF STEPHENVILLE AN
EASEMENT FOR SURFACE WATER DRAINAGE ON AND ACROSS LOTS 14 AND
26 OF BLOCK 146 OF THE CITY OF STEPHENVILLE IN ERATH COUNTY,
TEXAS, AGAINST LUCILE RAY AND INUS RAY, THE OWNERS OF SAID
LAND, AND TO PROSECUTE SAID CONDEMNATION PROCEEDINGS IN THE
MANNER PRESCRIBED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE:
The City of Stephenville requiring and easement for public
purposes and having failed to agree with the owners upon the
damages and consideration to be paid and given to LUCILE RAY
and INUS RAY, the owners, for easement for surface water
drainage on the following described land:
All that certain 0.776 acre tract of land, being part of Lots
14 and 26 of Block 146 of the city of Stephenville, and part
of the John Blair Survey, Abstract No. 32, in Erath County,
Texas, and being located in part of that certain 88.5 acre
tract described in deed from Mrs. Roxie McCloskey et vir to
T. A. Ray, dated December 29, 1923 and recorded in Volume
196, page 52 of the Deed Records of Erath County, Texas, and
described as follows:
BEGINNING at an iron rod set at the NE corner of a 17.40 acre
tract of land described in Substitute Trustee's Deed from
William H. Oxford, Substitute Trustee to the Stephenville
Bank and Trust Company, dated May 6, 1986 and recorded in
Volume 688, page 99 of the Deed Records of Erath County,
Texas, and the occupied south line of said T. A. Ray 88.5
acre tract described in deed mentioned above for an inner
corner of this tract, from which the NW corner of Lot 13, the
SW corner of Lot 14, the NE corner of Lot 22 and the SE
corner of Lot 24 of Block 146 of the City of Stephenville
bears S 300 12' E, 28.42 feet;
THENCE S 610 25' W, along the occupied south line of said
88.5 acre tract, 33.85 feet to the SW corner of this tract;
THENCE as follows: N 100 41' 49" W, 95.29 feet, N 370 35'
46" W, 194.86 feet, N 080 28' 43" W, 152.21 feet and N 270
51' 32" W, 226.77 feet to the NW corner of this tract;
THENCE N 620 08' 28" E, 50 feet to the NE corner of this
tract;
THENCE as follows: S 270 51' 32" E, 235.31 feet, S 080 28'
43" E, 147.76 feet, S 370 35' 46" E, 193.83 feet and S 100
41' 49" E, 120.74 feet to a point in the south line of Lot 14
of Block 146 of the City of Stephenville for the SE corner of
this tract;
THENCE S 600 00' W, 8.79 feet to the SW corner of said Lot 14
for a corner of this tract;
THENCE N 300 12' W, along the west line of said Lot 14, 28.42
feet to the place of beginning and containing 0.776 acre of
land.
Joseph A. Chandler and Randy Thomas, Attorneys for the
City of Stephenville, are hereby authorized on behalf of the
City of Stephenville to file proceedings to condemn the above
described land for purposes of such easement, such suit to be
against Lucile Ray and Inus Ray, owners of said land.
