HomeMy WebLinkAbout1989-O-08 - Retirement Housing ComplexORDINANCE NO. 1989-9 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF STEPHENVILLE BY CREATING A CLASSIFICATION FOR RETIREMENT HOUSING COMPLEX AND PROVIDING THE USE AND REGULATIONS THEREFOR IN THE CITY OF STEPHENVILLE. THE PLANNING AND ZONING COMMISSION OF THE CITY OF STEPHENVILLE HAVING STUDIED AND RECOMMENDED ZONING CLASSIFICATIONS FOR RETIREMENT HOUSING PURPOSES AND ALL HEARINGS AND NOTICES HAVING BEEN GIVEN AS PROVIDED BY THE ZONING ORDINANCE OF THE CITY OF STEPHENVILLE AND THE LOCAL GOVERNMENT CODE OF THE STATE OF TEXAS, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE AS FOLLOWS: Section One The classification of a Retirement Housing Complex is hereby created and made a part of the Zoning Ordinance of the City of Stephenville. Section Two A Retirement Housing Complex shall be a Primary Use in the following zoning districts: SECTION VII R-3 "Multiple Family Residential District" SECTION VIII B-1 "Neighborhood Business District" SECTION X "Central Business District" Section Three A Retirement Housing Complex shall be defined as follows and included in Section III of the Zoning Ordinance: DEFINITION: RETIREMENT HOUSING COMPLEX --A development providing dwelling units specifically designed for the needs of ambulatory elderly persons. To qualify as a Retirement Housing Complex, a minimum of 80% of the total units shall have a head of household who is 60 years of age or older. The remaining units may qualify by meeting one -of the following conditions: A. A unit is occupied by a household head who is 55 years of age or older; B. A unit is occupied by a surviving member (s) of a household, regardless of age, and the household head meeting the age requirement has died; C. A unit is occupied by management personnel and his or her family. In addition to the dwelling units, a Retirement Housing Complex may include special facilities Lind services for the exclusive use of the residents including a cafeteria and/or dining room, snack bar, convenience retail shop (food, household and gift items) , infirmary_,, library, game room, swimming pool, exercise room, arts anti crafts facilities, meeting room, greenhouse, -housekeeping service, beauty and/or barber shop, chapel, transportation service and related uses to provide a comfortable and convenient: living atmosphere. Section Four A Retirement Housing Complex- shall meet the area regulations intensity of use regulations, size regulations and height regulations established for multiple family dwelling: AREA REGULATIONS: A. Front Yard: 1. There shall be a front yard along the front line of the lot. The minimum depth of such yard shall be twenty-five feet (25'). 2. When a lot has double frontage the front yard requirements must be provided on both streets. B. Side Yard: All lots must have side yard setbacks of at least ten feet (10'). However, for buildings located on corner lots there must be a side yard setback from the intersectiong street of not less than twenty-five feet (25'). C. Rear Yard: A lot with a main use building located on it must have a rear yard of at least twenty feet (20'). INTENSITY OF USE: A lot on which there is erected a retirement housing complex, shall contain an area of not less than then thousand (10,000) square feet for the first: two (2) units, plus one thousand (1,000) square feet for each additional unit in excess of two (2). A minimum of one percent (1%) of such area shall be maintained as green space as defined in the Zoning Ordinance. SIZE REGULATIONS: The minimum area of the main building shall be eight hundred (800) square feet, exclusive of garage, breezeways and porches. p17T!•_AT i?F!'_iiT_ATTl1NC No building shall exceed thirty-five feet (35') in height. In addition to the requirements listed above, a Retirement Housing Complex shall also meet the "Special Requirements" listed as follows: SPECIAL REQUIREMENTS FOR RETIREMENT HOUSING CCi4PLEX: 1. Automatic fire sprinkler systems shall be. provided for all dwelling units. 2. All door widths shall be sufficient to ar:comodate wheelchairs. 3. Ramps shall be provided where steps are located. 4. Emergency signal facilities shall be provided in each dwelling unit to monitor for fire and other emergencies. Said facilities shall be monitored 24 hours a day. 5. Grab bars shall be installed around all bathtubs and showers. 6. All floor surfaces shall be of non-skid materials. A Retirement Housing complex shall provide parking spaces as follows and included in Section XIV of the Zoning Ordinance: PARKING SPACE REQUIREMENTS: For retirement housing developments, a minimun of one (1) parking space shall be provided for each dwelling unit in the complex, plus one (1) parking space for each staff member at maximum staff level, plus one (1) parking space for each employee of the related services provided on the development site.
