HomeMy WebLinkAbout1991-O-12 - Prescribing Rules and Regulations Governing Plats, Replats and Subdivision of LandORDINANCE NO. 1991-12 AN ORDINANCE PRESCRIBING RULES AND REGULATIONS GOVERNING PLATS, REPLATS AND SUBDIVISION OF LAND WITHIN THE CORPORATE LIMITS AND WITHIN ONE MILE OF THE CORPORATE LIMITS OF THE CITY OF STEPHENVILLE, PROVIDING FOR CERTAIN DEFINITIONS AND PROCEDURES; PROVIDING FOR REQUIREMENTS AND REGULATIONS FOR THE PREPARATION OF PRELIMINARY AND FINAL PLATS; PROVIDING FOR ACCEPTANCE OF SECTIONS AND REQUIREMENTS PRIOR TO ACCEPTANCE OF A FINAL PLAT; PRESCRIBING REGULATIONS FOR FILING PLATS, SUBDIVISION CONSTRUCTION AND ISSUANCE OF BUILDING PERMITS; PROVIDING STANDARDS RELATING TO BLOCKS, LOTS, STREETS, UTILITY EASEMENTS, SIDEWALKS, WATER SUPPLY, STORM SEWERS AND DRAINAGE; PRESCRIBING FEES TO BE CHARGED; ESTABLISHING JURISDICTION WITHIN THE CORPORATE LIMITS OF THE CITY AND WITHIN THE EXTRATERRITORIAL LIMITS THEREOF; PROVIDING FOR ENFORCEMENT; PROVIDING FOR VARIOUS IMPROVEMENTS FOR ALL SUBDIVISIONS; ESTABLISHING VARIANCES AND PRESCRIBING PENALTIES FOR VIOLATION OF ITS PROVISIONS NOT -TO -EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; REPEALING ALL CONFLICTING ORDINANCES; AND, PROVIDING FOR SEVERABILITY AND A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, under the laws of the State of Texas, hereafter every owner of any tract of land situated within the corporate limits of the City of Stephenville, or within the extraterritorial limits of such City of Stephenville, who may hereafter divide the same in two ( 2 ) or more tracts for the purpose of laying out any subdivision of such tract of land or any addition to said City of Stephenville, or for laying out suburban lots or building lots, or any lots and streets, and other portions intended for public use, or the use of purchasers or owners of lots fronting thereon or adjacent thereto, are required to submit a plat of such subdivision or addition for approval by the Planning and Zoning Commission of the City of Stephenville and, WHEREAS, the City Council of the City of Stephenville is empowered by law to promulgate and establish the general plan of said City and its streets, alleys, and public utility facilities, including those which have been or may be laid out, together with the general plan for the extension of such City and of its roads, streets and public highways within said City and within the extraterritorial limits established from the corporate limits thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF STEPHENVILLE, TEXAS: On and after the passage of this Ordinance any person, firm or corporation seeking approval of any plat, plan or replat of any subdivision of land within the corporate limits or within the extraterritorial limits from the corporate limits of the City of Stephenville shall be required to comply with the requirements of this Ordinance before such approval may be granted. This Ordinance shall become effective on the 1st day of July, 1991. INTRODUCED, PASSED AND APPROVED on this the 4th day of June, 1991. ATTEST: ITY SECRETARY
