HomeMy WebLinkAbout12/14/2011 - P&Z Meeting Minutes MINUTES OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF STEPHENVILLE, TEXAS, HELD ON, WEDNESDAY, DECEMBER 14, 2011 – 5:30 P.M. The regular meeting of the Planning and Zoning Commission of the City of Stephenville was called to order by Chairman Alisa Starbird, with the following members present: Chairman: Alisa Starbird Members: Caryl Chilton Metta Collier Tawnya Doggett Deanna Glasgow Matt Harpole Richard Petronis Jerry Warren Janet Whitley and with the following member absent: Dell Burdick. Also attending was Director of Community Development Betty Chew, and others. ITEM I: CONSIDER FOR APPROVAL MINUTES OF THE NOVEMBER 16, 2011 MEETING. Commissioner Harpole made the motion to approve the minutes of the November 16, 2011 meeting as written. Commissioner Petronis seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None. ITEM II: PUBLIC HEARING TO CONSIDER REQUEST TO REZONE FROM R-1 “SINGLE FAMILY RESIDENTIAL DISTRICT” TO B-2 “RETAIL AND COMMERCIAL BUSINESS DISTRICT”, LOT 7 (PART OF), BLOCK 156, CITY ADDITION, LOCATED AT THE SOUTHWEST CORNER OF THE 800 BLOCK OF WOLFE NURSERY ROAD AND THE 2800 BLOCK OF WEST FREY STREET. Betty Chew, Director of Community Development addressed the Commission stating, Doss Property Company, L.L.C. is the owner of this property located in the 2800 block of West Frey Street and the 800 block of Wolfe Nursery Road. The owner is requesting a change of zoning from R-1 “Single Family Residential District” to B-2 “Retail and Commercial Business District”. The Comprehensive Plan’s projected land use is commercial. There are no structures located on the property. The property may be served from twelve inch water mains and twelve inch sanitary sewer mains located in the West Frey Street and Wolfe Nursery Road rights of way. The property has frontage on West Frey Street and Wolfe Nursery Road both one hundred foot rights of way in the area. Fire protection is provided from existing fire hydrants located in West Frey Street and Wolfe Nursery Road. The property for which B-2 zoning is requested is bound to the north by a Planned Development District and B-2 zoning, to the south by B-2 zoning, to the west by Industrial District zoning, and to the east by “Exempt” property, Henderson Junior High School. . Chairman Starbird opened the floor for a public hearing. THOSE IN FAVOR OF ZONING REQUEST: None. THOSE OPPOSED TO ZONING REQUEST: None. Chairman Starbird closed the public hearing. Following Commission discussion Commissioner Chilton made the motion to recommend to the City Council that the request to rezone from R-1 “Single Family Residential District” to B-2 “Retail and Commercial Business District”, Lot 7 (part of), Block 156, City Addition, be approved. Commissioner Whitley seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None. ITEM III: PUBLIC HEARING TO CONSIDER COMMENTS REGARDING AMENDING THE CITY OF STEPHENVILLE ZONING ORDINANCE, SECTION 3: DEFINITIONS, “CONVENIENCE STORE”. Betty Chew, Director of Community Development addressed the Commission stating, the definition included in the agenda packet is the definition the Commission considered at work session for a “Convenience Store”. The City Attorney has reviewed the proposed definition and the Commission will now need to hear comments regarding this definition at Public Hearing. Chairman Starbird opened the floor for a public hearing. THOSE IN FAVOR OF ZONING ORDINANCE AMENDMENT: None. THOSE OPPOSED TO ZONING ORDINANCE AMENDMENT: None. Chairman Starbird closed the public hearing. The Commission discussed the proposed definition and recommended changing neighborhood to the public. Commissioner Warren made the motion to recommend to the City Council that the City of Stephenville zoning ordinance be amended to change the definition of “Convenience Store”: “Any area of land including the structures that is used to provide goods and services to the public including food products, snacks, newspapers, household cleaning supplies, paper goods, alcoholic beverages for off-premises consumption, lottery tickets, and gasoline. No drive-thru or drive-thru windows are allowed.” Commissioner Harpole seconded the motion. The motion carried by the following vote: AYES: All members present voted aye. NOES: None. The Commission thanked Chairman Starbird and Commissioner Glasgow for their service on the Commission. There being no other business to come before the Commission the meeting adjourned at 5:45p.m. _______________________________________________ Alisa Starbird, Chairman
