MINUTES OF THE PLANNING AND ZONING COMMISSION
OF THE
CITY OF STEPHENVILLE, TEXAS, HELD ON,
WEDNESDSAY, JANUARY 19, 2011 – 5:30 P.M.
The regular meeting of the Planning and Zoning Commission of the City of Stephenville was called to
order by Secretary Betty Chew, with the following members present:
Members: Dell Burdick
Caryl Chilton
Metta Collier
Tawnya Doggett
Deanna Glasgow
Matt Harpole
Richard Petronis
Alisa Starbird
Jerry Warren
Janet Whitley
and with the following members absent: None.
Also attending was Mayor Nancy Hunter, Council Member Martha Taylor, and others.
ITEM I: ELECTION OF CHAIRMAN AND VICE CHAIRMAN.
Commissioner Chilton made the motion to elect Alisa Starbird chairman of the
Planning and Zoning Commission for 2011. Commissioner Whitley seconded the
motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None.
Commissioner Harpole made the motion to elect Dell Burdick vice chairman of
the Planning and Zoning Commission for 2011. Commissioner Collier seconded
the motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None.
ITEM II: CONSIDER FOR APPROVAL MINUTES OF DECEMBER 15, 2010 MEETING.
Commissioner Whitley made the motion to approve the minutes of the
December 15, 2010 meeting as written. Commissioner Glasgow seconded the
motion. The motion carried by the following vote:
AYES: All members present voted aye.
NOES: None.
ITEM III: CONSIDER A ZONING CLASSIFICATION FOR A CONVENIENCE/GROCERY STORE
(WITH DRIVE-THRU SERVICE) IN THE CITY OF STEPHENVILLE ZONING
ORDINANCE.
Betty Chew, Director of Community Development, addressed the Commission
stating, this item was tabled at the December meeting and is now on the
agenda for final action. Currently the Zoning Ordinance does not classify this use
with drive-thru service. The B-2 “Retail and Commercial Business District” and I
“Industrial Districts” allow these uses without drive-thru service.
The Commission will need to decide if they want to allow these permitted uses
to have drive-thru service and in which zoning district, and forward a
recommendation to the City Council for consideration.
Chairman Starbird opened the floor for a public hearing.
THOSE IN FAVOR OF ZONING CLASSIFICATION:
Ann Correll, manager for Twisters Convenience Store, addressed the
Commission stating, if this classification is approved they would like to open ten
to fifteen stores in this chain in the future. They would also like to establish their
corporate offices in Stephenville. Ms. Correll stated this is a new concept and
that approximately 12% to 15% of the sales would be alcohol sales. There would
be no fuel sales proposed with this model. She further stated there would be no
sales outside of the cars as they drive through the store. Ms. Correll stated this
would be a full service convenience store with extensive food service.
THOSE OPPOSED TO ZONING CLASSIFICATION:
None.
Chairman Starbird closed the public hearing.
Following Commission discussion, Commissioner Burdick made the motion to
classify a convenience store with drive-thru service in the B-2 “Retail and
Commercial Business District” and I “Industrial District”. Commissioner Collier
seconded the motion. The motion failed to carry by the following vote :
AYES: Commissioners Burdick, Collier, Whitley, and Harpole.
NOES: Commissioners Petronis, Chilton, Warren, Glasgow, Doggett, and
Chairman Starbird.
ITEM IV: CONSIDER FINAL PLAT OF ALLSUP’S SUBDIVISION, BEING 4.51 ACRES OF LAND
IN THE JOHN BLAIR SURVEY, ABSTRACT 32, CITY OF STEPHENVILLE, ERATH
COUNTY, TEXAS.
Betty Chew, Director of Community Development, addressed the Commission
stating, Allsup’s Subdivision is a proposed 4.51 acre commercial subdivision. The
developer is presenting the Final Plat for a 2 lot subdivision. Lot 1 is a 4.25 acre
commercial lot which is being developed with a new retail convenience store.
Lot 2 is a 0.26 acre, City of Stephenville water well site. Allsup’s Convenience
Store, Inc. is the developer of the subdivision with Dunaway Associates, Inc.
serving as project engineer. The subdivision will be served from an 8 inch water
main located in the Bluebonnet Street right of way. The subdivision will be
served from an existing 12 inch sanitary sewer main located in a utility
easement crossing the northeast side of the subdivision. The subdivision has
frontage on the Northwest Loop, a 120 foot major arterial street. There will be a
fully functioning traffic signal and pavement widening and striping
improvements made, by the developer, to facilitate traffic movement and
enhance traffic safety in this area. A 50 foot utility and drainage easement is
dedicated along the west and north boundary lines of Lot 1. There is an existing
20 foot sanitary sewer easement crossing Lot 1. A 10 foot utility easement is
dedicated on the east boundary line of Lot 1 and all sides of Lot 2. Stormwater
flows from south to north across the subdivision. Stormwater from the
subdivision and the Northwest Loop drains into the drainage easement. The
outfall for the drainage easement flows to TXDOT right of way.
The Community Development staff has reviewed the Final Plat of Allsup’s
Subdivision and determines it complies with the requirements of the
Subdivision Ordinance for a Final Plat and recommends approval as presented.
Commissioner Whitley made the motion to recommend to the City Council that
the Final Plat of Allsup’s Subdivision being 4.51 acres of the John Blair Survey,
Abstract 32, City of Stephenville, Erath County, Texas be approved as presented.
Commissioner Harpole seconded the motion. The motion carried by the
following vote:
AYES: All members present voted aye.
NOES: None.
ITEM V: CONSIDER COMMENTS REGARDING THE CITY OF STEPHENVILLE ZONING
ORDINANCE BY ADDING SECTION 6.7 DT “DOWNTOWN DISTRICT” ZONING
CLASSIFICATION.
Betty Chew, Director of Community Development, addressed the Commission
stating, the changes to the Downtown District which were recommended at the
joint work session with the City Council have been incorporated into this draft.
The Commission reviewed the draft of the “Downtown District” as amended.
Commissioner Burdick made the motion to recommend to the City Council that
the City of Stephenville Zoning Ordinance be amended by adding Section 6.7 DT
“Downtown District” Zoning Classification. Commissioner Harpole seconded the
motion. The motion carried by the following vote.:
AYES: All members present voted aye.
NOES: None.
There being no other business to come before the Commission the meeting
adjourned at 7 p.m.
