MINUTES OF THE PLANNING AND ZONING COMMISSION
OF THE
CITY OF STEPHENVILLE, TEXAS, HELD ON,
WEDNESDAY, APRIL 15, 2015 – 5:30 P.M.
ITEM I: CALL TO ORDER.
The regular meeting of the Planning and Zoning Commission of the City of
Stephenville was called to order at 5:30 pm by Chairman Janet Whitley with the
following members present:

Metta Collier
Justin Allison
Members Absent: Kerry Schindler
Others in attendance: Russ McDaniel, City Council Mayor Pro-Tem; Alan Nix,
City Council Member; Judy Miller, Planning and Building Services Director;
Tom Heap, Building Official; Bruce Cole, GIS Coordinator/Planner, and others.
ITEM II: DISCUSSION AND RECOMMENDATION TO THE CITY COUNCIL
REGARDING THE REQUEST OF AUSTIN AND BROOK HARRIS,
OWNERS, TO REZONE FROM R1 SINGLE FAMILY RESIDENTIAL
DISTRICT TO R3 MULTI-FAMILY RESIDENTIAL DISTRICT 8.517
ACRES OF LAND OUT OF THE HENRY PEESON SURVEY A-613
ERATH COUNTY TEXAS CITY OF STEPHENVILLE, TEXAS
LOCATED NEAR BOB WHITE STREET.
Judy Miller took the floor on this subject and stated that this property is industrial
property and should be zoned retail commercial.
Austin Harris is wanting to rezone this property for the purpose of putting in
duplexes/apartments, no single family homes.
Janet Dentler, homeowner on Bob White had concerns with property and tax
value, privacy and traffic issues, safety for the children.
There was also the issue of spot zoning mentioned by Commissioner Petronis.
Commissioner Petronis made the motion to not approve rezoning. Motion was
not seconded.
Motion to approve rezoning was made by Metta Collier. Justin Allison seconded
it.
AYES: Whitly, Collier, LaTouche, Lovell, Allison, Muncey, Schlinder
NOES: Petronis, Baxter, & Wallace
ITEM III: THE REQUEST OF DALLS SIMS, OWNER, TO REZONE FROM R1
SINGLE FAMILY RESIDENTIAL DISTRICT TO R3 MULTI-FAMILY
RESIDENTIAL DISTRICT.
Judy Miller opened the floor with the staff report. She stated that this property is
surrounded largely by R3 district. R1 in center. There is a house on this property
that has not been occupied in five years. It is in much need of repair.
Alan Hutchins stated that he is wanting to put in townhouse/ 4-plex condimenium
style housing that single families and students can both live.
Commissioner Whitly stated the people that live there need to be considered
before the characteristics of the neighborhood are changed.
Priscilla Gaston, who owns property on 760 Pecan, asked about tree policies. She
also stated her concern with parking and all the concrete that will replace grass
and trees.
Motion to deny the change in zoning was made by Commissioner Petronis. It was
seconded by Metta Collier.
AYES: Petronis, Baxter, Schindler, Lovell, Whitly, Collier, Muncey, Wallace
NOES: LaTouche & Allison
ITEM IV: DISCUSSION AND RECOMMENDATION TO THE CITY COUNCIL
REGARDING THE REQUEST OF TRENT GAY, OWNER, TO REPLAT
LOT 3, LOT 4, PART OF LOT 5 BLOCK 2 TRAYWICK ADDITION
ZONE R1 SINGLE FAMILY RESIDENTIAL DISTRICT LOCATED ON
SPRING MEADOW.
Judy Miller stated this is a replat Public Hearing to create two additional lots in
this area.
There were concerns of flooding issues. Ken Dees, with Chalk Mountain
Engineering out of Irving, Texas, stated the property is an AE Zone which means
a flood study has been done. He also said the lots are 5 ft above where the
building will occur which will make it safe from flooding. He said rezoning is
unnecessary, they just want to make better use of the land.
A motion to approve this recommendation was made by Commissioner Baxter
and seconded by Commissioner Lovell.

ITEM V: DISCUSSION AND RECOMMENDATION TO THE CITY COUNCIL
REGARDING THE FINAL PLAT OF GOLF COUNTRY ESTATES TO
BEING 14.551 ACRES OF LAND OUT OF THE JARRETT-MINNIFY
SURVEY ABSTRACT #520 ERATH COUNTY CITY OF
STEPHENVILLE, TEXAS.
Judy Miller stated that this is the final plat of Golf Country Estates. The final plat
is the NE part of the city. The 14.551 acres of land are divided into three lots.
Each lot varies from 2.1 to 4.1 acres and is an R1 which meet the minimum
requirements. No golf holes being disturbed by this plat. She stated she believes
this a good addition to the city. Flood study has been performed on this plat per
Ken Dees.
A motion to approve final plat was made and seconded.
AYES: UNANIMOUS
ITEM VI: PLANNING AND BUILDING SERVICES DEPARTMENT REPORT:
Judy Miller introduced Bruce Cole. He gave a summary of his background and
his day to day activities as a GIS Planner.
ITEM VII: FUTURE AGENDA ITEMS:
Rezone Bosque River Center from Industrial to Commercial Retail.
North Dale is listed as an R3 multi-family. Want to get this rezoned to an R1.
Commissioner Whitley suggested the Council start having a work session. The

first one will be held Wednesday, May 3.
