MINUTES OF THE PLANNING & ZONING COMMISSION FILE COPS OF THE CITY OF STEPHENVILLE, TEXAS, HELD ON TUESDAY, OCTOBER 25 , 1988 - 6 : 00 P .M. A special meeting of the Planning & Zoning Commission of the City of Stephenville, Texas was called to order by Chairman Charles Castleberry with the following members present : Chairman: Charles Castleberry Members : Don Beach Billy Hassler Nicki Beth Jones Sam Taylor David Tomlinson Bill Trogdon and with the following members absent : Virginia Dorris , Jerry Singleton and Barbara Terrell . Others attending were City Administrator Kurt Ackermann, Director of Public Works Danny Johnson, Planning & Inspections Coordinator Betty Chew and others . ITEM I : CONSIDER FOR APPROVAL MINUTES OF SEPTEMBER 15 , 1988 MEETING. Commissioner Tomlinson moved approval of the minutes of the September 15 , 1988 meeting as written. Commissioner Trogdon seconded the motion. The motion carried by the following vote : AYES : All members present voted aye. NOES : None. ITEM III : PUBLIC HEARING TO CONSIDER REQUEST TO REZONE FROM B-2 SECONDARY AND HIGHWAY BUSINESS DISTRICT TO R-2 ONE- FOUR FAMILY DWELLING DISTRICT" , LOTS 1 THRU ; BLOCK 5 ; NORTH IJEDGEWOOD ADDITION, LOCATED ON THE SOUTH SIDE OF WEDGEWOOD DRIVE . Chairman Castleberry stated since Agenda Items #3, #4, and #5 pertain to the same property the Commission would have discussion of these items together but would take action on each item separately. Chairman Castleberry opened the floor for a public hearing to consider request to rezone from B-2 "Secondary and Highway Business District" to R-2 "One-Four Family Dwelling District" , Lots 1 thru 20 ; Block 5 ; North Wedgewood Addition, located on the south side of Wedgewood Drive. Betty Chew Planning & Inspections Coordinator, addressed the Commission stating Kenneth Currier owner of the property is requesting the change of zoning from B-2 1. "Secondary and Highway Business District" to R-2 "One-Four Family Dwelling District . Mr. Currier is proposing to replat the property to allow development of the property with duplex/townhouse type residences . The replat and site development plan for the property will be presented as Agenda Items #4 and #5 . The Comprehensive Plans projected land use is residential. There are no structures located on the property at this time. The property may be served from a 6 inch water main located in Wedgewood Drive . Extension of sewer mains will be required to supply sanitary sewer service to the lots . The developer will need to install water and sewer taps to serve the proposed lots . The property has street frontage on Wedgewood Drive a 60 foot right-of-way. Fire protection is provided by hydrants located on the northeast corner of Wedgewood and Cypress and the northwest corner of Wedgewood and Maple Lane. The property for which R-2 zoning is requested is bound to the north and east by R-1 "Single-Family Dwelling District" zoning and to the south and west by B-2 "Secondary and Highway Business District" zoning. ITEM IV: CONSIDER PRELIMINARY PLAT OF A REPLAT OF LOT 1; BLOCK 5 ; NORTH WEDGEWOOD SUBDIVISION, ERATH COUNTY, TEXAS. Betty Chew Planning & Inspections Coordinator addressed the Commission stating Block 5 , North Wedgewood Subdivision was originally platted as a single 5 . 788 acre commercial tract. The proposed resubdivision of Block 5 , North Wedgewood Subdivision contains 21 lots . Lots 1 thru 20 , fronting on Wedgewood Drive , are being platted for development with duplex/townhouse type structures . Lot 21 , Block 5 , North Wedgewood Subdivision is a proposed 3 . 36 acre commercial lot to be developed with commercial lease space and mini-warehouse storage area . Review of the preliminary plat indicates Lots 1 thru 20 may be served from a 6 inch water main located in Wedgewood Drive. Lot 21 may be served from a 12 inch water main located in the Lingleville Hwy. Lots 1 thru 20 may be served by extension from sewer mains located along Wedgewood Drive. Lot 21 may be served from an existing 6 inch sewer main located in the Lingleville Hwy . The developer will install water and sewer taps for Lots 1 thru 20 . A protion of Lot 21 may be served from an existing water and sewer tap . Additional taps may be needed to serve remaining portions of the lot. Fire protection for Lots 1 thru 20 will be provided from existing fire hydrants . Fire protection for Lot 21 will be provided in part from existing hydrants . The developer will need to install an additional fire hydrant along the Lingleville Hwy . to meet State Board of Insurance requirements . The developer proposes a 25 foot access and utility easement along the rear lot line of Lot 21, Block 5 , North Wedgewood Subdivision. This easement is to be paved with a sealed surface pavement and will be used as driving and loading area 2 . for the mini-warehouse units and rear entrance drive- ways for the residential lots . The proposed resubdivision is bound by the Lingleville Hwy. , Wedgewood Drive, Paddock Ave. and North Columbia Ave . Excepting the Lingleville Hwy. the other streets have been paved and curb and gutter installed by Mr. Currier. The Lingleville Hwy. is paved but has no curb and gutter. The developer is proposing three entrances on the Lingleville Hwy. and one entrance on North Columbia for the commercial development . Lot grading plans for Lots 1 thru 20 will need to be submitted and approved at the time application is made for building permits . An engineered drainage plan for Lot 21 will need to be submitted and approved at the time application is made for a building permit . ITEM V: CONSIDER SITE DEVELOPMENT PLAN FOR BLOCK 5 , NORTH WEDGEWOOD SUBDIVISION. Betty Chew Planning & Inspections Coordinator, addressed the Commission noting a Site Development Plan for Block 5 , North Wedgewood Subdivision is being submitted for consideration by Mr. Kenneth Currier. The Planning and Inspections Staff has reviewed Mr. Curriers ' proposal and notes Lots 1 thru 20, Block 5 , North Wedgewood Subdivision are to be platted for development with duplex/townhouse type structures . The lots are being platted so each dwelling unit may be under separate ownership if desired. The proposed Lots 1 thru 20 , Block 5 , North Wedgewood Subdivision meets the minimum regulations established by the Zoning Ordinance Section VI for these type lots . Lot 21, Block 5 , North Wedgewood Subdivision will be developed with a commercial lease area totaling 21, 500 square feet and two mini-warehouse buildings totaling 20, 160 square feet of storage area. The proposed site development plan for Lot 21, Block 5, North Wedgewood Subdivision meets the minimum regulations established by the Zoning Ordinance Sections IX, XIII and XIV. THOSE IN FAVOR OF AGENDA ITEMS #3 , #4, AND #5 . Kenneth Currier, owner of the property addressed the Commission stating he was requesting rezoning of Lots 1 thru 20, Block 5 , North Wedgewood Subdivision to serve as a buffer for the single-family residential property to the north and the commercial property to the south. Mr. Currier further stated he would construct and own the commercial buildings and lease the spaces . THOSE OPPOSED TO AGENDA ITEMS #3 , #4, AND #5 . None. ITEM III : Commissioner Trogdon moved the Planning & Zoning Commission recommend to the City Council that the 3 . request to rezone from B-2 "Secondary and Highway Business District" to R-2 "One-Four Family Dwelling District" , Lots 1 thru 20, Block 5, North Wedgewood Addition, located on the south side of Wedgewood Drive, be approved. Commissioner Hassler seconded the motion. The motion carried by the following vote : AYES : All members present voted aye. NOES : None. ITEM IV: Commissioner Trogdon moved the Planning & Zoning Commission recommend to the City Council that the Preliminary Plat of a Replat of Lot 1, Block 5 , North Wedgewood Subdivision be approved as presented with an additional fire hydrant being installed by the developer along the Lingleville Hwy. frontage. Commissioner Taylor seconded the motion. The motion carried by the following vote: AYES : All members present voted aye. NOES : None . ITEM V: Commissioner Tomlinson moved the Planning & Zoning Commission recommend to the City Council that the Site Development Plan for Block 5, North Wedgewood Subdivision be approved as presented. Commissioner Hassler seconded the motion. The motion carried by the following vote : AYES : All members present voted aye . NOES : None. ITEM II: PUBLIC HEARING TO CONSIDER REQUEST TO REZONE FROM B-3 "CENTRAL BUSINESS DISTRICT" TO B-3 MH "CENTRAL BUSINESS MANUFACTURED HOUSING DISTRICT" , PART OF BLOCK ; AND PART OF LOTS E , H ; BLOCK 5 ; CITY ADDITION , CONTAINING ACRES , LOCATED SOUTH OF E . CROW STREET . Chairman Castleberry opened the floor for a public hearing to consider request to rezone from B-3 "Central Business District" to B-3/MH "Central Business/Manufactured Housing District" , Part of Block 44; and Part of Lots 1E, 1H; Block 45 ; City Addition, containing 2 . 14 acres , located south of E. Crow Street . Betty Chew Planning & Inspections Coordinator, addressed the Commission stating Barbara Hampton, owner of the property is requesting a Manufactured Housing zoning classification to permit development of the site with four mobile home spaces and the existing single-family residence. Mrs . Hampton has indicated she will present a site development plan to the Commission and City Council at a later date if the manufactured housing zoning classification 4. is approved. The Comprehensive Plans projected land use is residential. There are two permitted residences located on the property at this time, a site built single-family residence and a mobile home which is permitted by Special Exception for two years granted by the Board of Adjustment October 8 , 1987 . Application for a Special Exception for a second mobile home on the site was denied by the Board of Adjustment April 14, 1988 . The property is served by a 6 inch water main located in Crow Street . There is an existing water tap serving the property. The property is not served by a sanitary sewer main due to elevation. Individual septic tanks serve the site. The property has 30 feet of frontage on Crow Street a 50 foot right-of- way. Fire protection is provided by hydrants located at Crow and Minter and Crow and Devine . The Property for which B-3/MH zoning is requested is bound on all sides by B-3 "Central Business District" zoning. The Commission should note if a Manufactured Housing zoning classification is approved it will not permit other mobile homes to be moved onto the property until a site development plan has been reviewed and approved by the Commission and City Council with regard to the Mobile Home Park Ordinance . THOSE IN FAVOR OF ZONING CHANGE : None. THOSE OPPOSED TO ZONING CHANGE : None. There being no one else present wishing to address the Commission regarding this agenda item, Chairman Castleberry closed the public hearing. The Commission discussed the request with regard to the property access to a public street and with regard to its proximity to the flood hazard area. Commissioner Hassler moved the Planning & Zoning Commission recommend to the City Council that the request to rezone from B-3 "Central Business District" to B-3/MH "Central Business/Manufactured Housing District" , Part of Block 44; and Part of Lots lE, 1H; Block 45 ; City Addition, containing 2 . 14 acres , located south of East Crow Street be denied. Commissioner Taylor seconded the motion. The motion carried by the following vote : AYES : Commissioners Beach, Hassler, Jones , Taylor, Trogdon and Chairman Castleberry. NOES : Commissioner Tomlinson. 5 . Chairman Castleberry informed the Commission of proposed revisions to Section XIII-III of the City Zoning Ordinance regarding garbage collection and refuse receptacle requirements . It was the consensus of the Commission to have this placed on the November 17 , 1988 Planning & Zoning Commission agenda and hold public hearing to hear comments. regarding this request . There being no other business to come before the Commission the meeting adjourned at 7 : 00 P .M. i harles Castleberr , Chairman 6 .
