Regular City Council Meeting
Tuesday, May 5, 2020 at 5:30 PM
The City Council of the City of Stephenville, Texas, convened on Tuesday, May 5, 2020, at 5:30 PM, in the
Council Chambers at City Hall, 298 West Washington Street, for the purpose of a Regular Business Meeting,
with notice of said meeting, giving the date, time, place and subject thereof, having been posted as
prescribed by Chapter 551, Government Code, Vernon's Texas Codes Annotated, with the following
members present, to wit:

I. Call to Order
Mayor Svien called the meeting to order at 5:30 p.m.
II. Pledges of Allegiance
Justin Haschke led the Pledges of Allegiance.
III. Finance
Monica Harris, Director of Finance
1. Consider Approval of the 2018-2019 Comprehensive Annual Financial Report
Mike Brooks, CPA, Brooks Watson & Co., presented the FY2018-2019 Audit to council.
The auditor's report expressed an unmodified "clean" opinion that the financial
statements present fairly, in all material respects, the respective financial position of the
City of Stephenville as of September 30, 2019.
MOTION by Alan Nix, second by Mark McClinton, to approve the Comprehensive Financial
Report.
MOTION CARRIED by unanimous vote.
2. Monthly Budget Report for the Period Ending March 31, 2020
Monica Harris, Director of Finance, gave the following report:
In reviewing the financial statements ending March 31, 2020, the financial indicators are
as expected.
Property Tax - We received $38K in property taxes in the month of March, resulting in a
$304K or 5.14% increase over funds collected through March last fiscal year. The $6.23
million collected through March is 97% of budget, which is consistent with the prior year
collections.
Sales Tax - We received $504K in sales tax in March, resulting in $20K or .62% over the
target budget through March. We received $28K or .86% more than the funds received
through last March.
HOT Funds - We received $169K in revenue in the Hotel Occupancy Tax fund through
March, as compared to $170K in revenue through last March. We spent $95K in Hotel
Occupancy Tax funds through March as compared to $148K last year.
Revenue (Budgetary comparison) - The target budget for operating revenue is $14.1
million. We received $16.5 million in revenue through March, resulting in $2.4 million
over the target budget. This is a result of property taxes, which are billed October 1st and
due by January 31st, and insurance proceeds.
Expenditures (Budgetary comparison) - The target budget for operating expenditures is
$10.4 million. We expended $9.5 million through March, resulting in $870K under the
target budget.
Revenue (Prior year comparison) - Operating revenue received last year was $15.3
million as compared to the current year's $16.5 million, resulting in a $1.2 million increase
due to service charges, insurance proceeds, and property taxes.
Expenditures (Prior year comparison) - Operating expenditures last year were $9 million
as compared to the current year's $9.5 million, resulting in a $527K increase due to wages
and benefits, training, maintenance, utilities, outside professionals, and marketing for
SEDA.
New Programs - Work is progressing on the CDBG GLO Storm Drainage project,
and the $2 million advanced funding for Graham Avenue has been paid to TxDOT.
Investments - The total market value of cash and investments on March 31, 2020
was $32,617,360. This is split 9% in demand accounts, 7% in brokered certificates
of deposits, 57% in TexStar investment pool, and 27% in TexPool investment pool.
We earned $117K in interest for the quarter. The average yield to maturity for all
account types for the quarter was 1.30%. The average yield to maturity for
investment accounts for the quarter was 1.52%. The average yield to maturity for
a 3 month treasury bill for the quarter was 1.10%.
IV. COVID-19
1. Consider Operation of City Facilities and Programs
Staff and council discussed the operation of certain city facilities and programs.
The city will move forward with the July 4th Celebration.
SPARD Summer Day Camp will be held, but with reduced enrollment.
Street projects will be delayed for 30 days.
Decisions regarding the opening of Splashville will be delayed until the Governor
announces guidelines for swimming pools.
2. Consider Approval of Amendments to Local State of Disaster Due to Public Health
Emergency
MOTION by Mark McClinton, second by Carla Trussell, to approve amendments to the
Local State of Disaster as presented, to include a 60 day suspension of the city's garage

sale ordinance.
MOTION by Brandon Huckabee, second by Ricky Thurman, to strike Section 2.3 of the
Local State of Disaster. MOTION CARRIED by unanimous vote.
MOTION by Mark McClinton, second by Carla Trussell, to approve amendments to the
Local State of Disaster as presented and amended, to include a 60 day suspension of the
city's garage sale ordinance.
MOTION CARRIED by unanimous vote.
3. Consider Approval of an Ordinance Amending the City of Stephenville Policy and
Procedure Manual to include a Pandemic Leave Policy and Telecommuting Policy
MOTION by Ricky Thurman, second by Mark McClinton, to approve Ordinance No. 2020-
0-15 Amending the City of Stephenville Policy and Procedure Manual.
MOTION CARRIED by unanimous vote.
4. Consider Approval of a Resolution Authorizing the Application for the Coronavirus
Emergency Supplemental Funding Grant
MOTION by Mark McClinton, second by Brandon Huckabee, to approve Resolution No.
2020-R-13 Authorizing the Application for the Coronavirus Emergency Supplemental
Funding Grant.
MOTION CARRIED by unanimous vote.
V. Planning and Zoning Commission

1. PUBLIC HEARING
CASE No.: RP2020-001
Applicant is Requesting a Replat of the Property Located at 224, 244, 280, and 290
Mcllhaney, being Lots 14, 15, 16, 17, and 34, Block 134, of the City Addition to the City
of Stephenville, Erath County, Texas.
Steve Killen, Director of Development Services, presented the case to council. The replat
received a unanimous positive recommendation from the Planning and Zoning
Commission.
Mayor Svien opened the public hearing. No one came forward to speak in favor of or
opposition to the replat.
2. Consider Approval of a Replat of a Property Located at 224, 244, 280, and 290
Mcllhaney, Being Lots 14, 15, 16, 17, and 34, Block 134 of the City Addition of the City of
Stephenville, Erath County, Texas
MOTION by Mark McClinton, second by Brandon Huckabee, to approve a replat of a
property located at 224, 244, 280, and 290 Mcllhaney, Being Lots 14, 15, 16, 17, and 34,
Block 134 of the City Addition of the City of Stephenville, Erath County, Texas.
MOTION CARRIED by unanimous vote.
3. PUBLIC HEARING
Case No. RP2020-002: Applicant is Requesting a Replat of a Property Located at 645
McCart, Being Lots 3-N and 2, Block 10, of the Shappard & Collins Addition to the City of

Steve Killen, Director of Development Services, presented the case to council. The replat
received a 6-1 positive recommendation from the Planning and Zoning Commission.
Mayor Svien opened the public hearing. No one came forward to speak in favor of or
opposition to the replat.
4. Consider Approval of a Replat of a Property Located at 645 McCart, Being Lots 3-N and
2, Block 10, of the Shappard & Collins Addition to the City of Stephenville, Erath County,
Texas
MOTION by Alan Nix, second by Mark McClinton, to approve the replat of a property
located at 645 McCart, being Lots 3-N and 2, Block 10 of the Shappard & Collins Addition
to the City of Stephenville, Erath County, Texas with the following conditions:
1. The Plat should reflect a 16' Utility Easement along N Paddock Ave for
existing water line.
2. The Plat must include the required language for Plats in regards to Easement
access by the City of Stephenville. The language has been provided to the
Applicant

5. PUBLIC HEARING
Case No. AZ2020-001: Establish Zoning for Voluntarily Annexed Property Located at
1330 N US 281, Being 3.34 acres of the William Survey, A0804, to the City of
Stephenville, Erath County, Texas
Steve Killen, Director of Development Services, presented the case to council. The
recommending zoning of Industrial (1) received a unanimous positive recommendation
from the Planning and Zoning Commission.
Mayor Svien opened the public hearing. No one came forward to speak in favor of or
opposition to the zoning.
6. Consider Approval of Zoning for a Voluntarily Annexed Property Located at 1330 N US
281, Being 3.34 Acres of the William Survey, A0804, to the City of Stephenville, Erath
County, Texas
MOTION by Brandon Huckabee, second by Gerald Cook, to approve Ordinance No. 2020-
0-17 establishing the zoning for the property located at 1330 N US 281, being 3.34 acres
of the William Survey, A0804 to the City of Stephenville, Erath County, Texas as Industrial
(1)-
MOTION CARRIED by unanimous vote.
7. PUBLIC HEARING
Case No.: AZ2020-002: Establishing Zoning for the New Extraterritorial Jurisdiction
Boundary Resulting from a Voluntary Annexation of a Property Located at 1330 N US
281, Being 3.34 Acres of the William Survey, A0804, to the City of Stephenville, Erath
County, Texas.
Steve Killen, Director of Development Services, presented the case to council. The
recommending zoning of Industrial (1) received a unanimous positive recommendation
from the Planning and Zoning Commission.

8. Consider Approval of Zoning for the New Extraterritorial Jurisdiction Boundary Resulting
from a Voluntary Annexation of a Property Located at 1330 N US 281, Being 3.34 Acres
of the William Survey, A0804, to the City of Stephenville, Erath County, Texas.
MOTION by Mark McClinton, second by Carla Trussell, to approve Ordinance No. 2020-0-
17 establishing zoning for the new extraterritorial jurisdiction boundary resulting from the
voluntary annexation of a property located at 1330 N US 281, being 3.34 acres of the
William Survey, A0804, to the City of Stephenville, Texas as Industrial (1).
MOTION CARRIED by unanimous vote.
9. PUBLIC HEARING
Case No. RZ2020-004: Applicant is Requesting a Rezone of a Property Located on Race
Street, Being Block 1, Lot 1B, of the Frey First Addition to the City of Stephenville, Erath
County, Texas, From Neighborhood Business District (B-1) To Multiple Family District (R-
3)
Steve Killen, Director of Development Services, presented the case to council. The rezone
received a 6-1 positive recommendation from the Planning and Zoning Commission.
Mayor Svien opened the public hearing.
Mary Winslow, 3500 County Road 419, Stephenville, spoke in favor of the rezone.
No one came forward to speak in opposition of the rezone.
Mayor Svien closed the public hearing.
10. Consider Approval of an Ordinance Rezoning a Property Located on Race Street, Being
Block 1, Lot 1B, of the Frey First Addition to the City of Stephenville, Erath County,
Texas, From Neighborhood Business District (B-1) To Multiple Family District (R-3).
MOTION by Brandon Huckabee, second by Brady Pendleton, to approve Ordinance No.
2020-0-18 rezoning the property located on Race Street, being Block 1, Lot 1B of the Frey
First Addition of the City of Stephenville form Neighborhood Business District (B-1) to
Multiple Family District (R-3).
MOTION CARRIED by the following votes:
Ayes: Mark McClinton, Nick Robinson, Brady Pendleton, Ricky Thurman,
Gerald Cook, and Brandon Huckabee
Noes: Carla Trussell and Alan Nix
11. PUBLIC HEARING
Case No. RZ2020-005: Applicant is Requesting a Rezone of a Property Located at 2811
W. Washington, Being, Lot 8, Block A, of the FMC Technologies Addition to the City of
Stephenville, Erath County, Texas, From Industrial District (1) to Retail and Commercial
Business District (B-2)
Steve Killen, Director of Development Services, presented the case to council. The rezone
received a unanimous positive recommendation from the Planning and Zoning
Commission.

12. Consider Approval of an Ordinance Rezoning a Property Located at 2811 W.
Washington, Being, Lot 8, Block A, of the FMC Technologies Addition to the City of
Stephenville, Erath County, Texas, From Industrial District (1) to Retail and Commercial
Business District (B-2)
MOTION by Brandon Huckabee, second by Mark McClinton, to approve Ordinance No.
2020-0-19 rezoning a property Located at 2811 W. Washington, Being, Lot 8, Block A, of
the FMC Technologies Addition to the City of Stephenville, Erath County, Texas, from
Industrial District (1) to Retail and Commercial Business District (B-2).
MOTION CARRIED by unanimous vote.
VI. Police Department
Dan M. Harris, Jr., Chief of Police
1. Consider Approval of a Contract for Body -Worn and In -Car Camera System
MOTION by Alan Nix, second by Nick Robinson, to approve a contract with Axon for body -
worn and in -car camera systems.
MOTION CARRIED by unanimous vote.
2. Consider Authorization for an Air Quality Assessment for the Public Safety Building
MOTION by Mark McClinton, second by Brandon Huckabee, to authorize an air quality
assessment for the Public Safety Building.
MOTION CARRIED by unanimous vote.
VI1. Stephenville Type B Economic Development Authority Update
Jeff Sandford, Executive Director, began by thanking council member Carla Trussell for her service
to the city and welcoming Justin Haschke to the city council. Mr. Sandford updated council on
unemployment trends and the programs in place to support businesses during COVID-19.

IX. SWEARING -IN OF COUNCIL MEMBERS
1. Comments from Outgoing Council Member Carla Trussell
Council member Carla Trussell said that it has been an honor to serve the citizens of
Stephenville and she hoped that they were pleased with her representation. Ms. Trussell
stated that she is a fifth generation Stephenville resident and she hopes she left it better
for those that come after her.

2. Oath of Office for Council Members
Staci King, City Secretary, administered the Oath of Office to Doug Svien, Mayor; Justin
Haschke, City Council Place 2; Brady Pendleton, City Council Place 4; Alan Nix, City Council
Place 6; Brandon Huckabee, Place 8.
X. Comments by Council Members
The council all thanked Carla Trussell for her service to the city and welcomed Justin Haschke to
the council.
Council member Ricky Thurman wanted to thank Stephenville and residents for staying strong
during the past few months. He encouraged everyone to support their local businesses and
continue to do so in the future.
Council member Brandon Huckabee expressed his hope for a continuing positive trend as
businesses continue to open and we move through summer.
Council member Alan Nix thanked the residents of Stephenville and its businesses for
their actions during the pandemic. He also thanked city staff for their hard work during
this time.
Council member Gerald Cook thanked staff and SEDA for their hard work during the
COVID-19 pandemic.
