Barnes, City Manager Staci L. King, City Secretary Randy Thomas, City Attorney I. Call to Order Mayor Svien called the meeting to order at 5:30 p.m. II. Pledges of Allegiance Council member Gerald Cook led the Pledges of Allegiance. III. Invocation by David Bearden, Graham Street Church of Christ IV. Regular Agenda 1. Citizens' General Discussion Representatives from Tarleton Roundup gave a presentation to council regarding their upcoming event. Tammi Gardner, Community Outreach Housing, addressed the council regarding partnering with the City to help clean up old, abandoned houses and to help provide affordable housing to the residents of Stephenville. 2. Consider All Matters incident and Related to The Issuance and Sale of the City of Stephenville, Texas Combination Tax and Revenue Certificates of Obligation, Series 2020, Including the Adoption of an Ordinance Authorizing the Issuance of Such Certificates, Approving an Official Statement, A Paying Agent/Registrar Agreement and an Engagement Letter of Bond Counsel. Eric Macha, Hilltop Securities, and Dan Culver, McCall, Parkhurst & Horton, LLP, were in attendance to explain the details of the Certificates of Obligation. Kim Leaverton addressed the council to speak in favor of the Certificates of Obligation and to encourage the council to seek input from residents on the Harbin Drive Project. MOTION by Brandon Huckabee, second by Gerald Cook, to approve an ordinance authorizing the issuance and sale of the City of Stephenville, Texas Combination Tax and Revenue Certificates of Obligation, Series 2020 and all matters incident thereto. MOTION CARRIED by the following votes: Ayes: Gerald Cook, Brandon Huckabee, Mark McClinton, Nick Robinson, Brady Pendleton, Ricky Thurman, and Alan Nix Noes: Carla Trussell 3. Recess to TIRZ Board Meeting Mayor Svien recessed the meeting to the Tax Increment Reinvestment Zone Board Meeting at 5:58 p.m. The meeting was called back into regular session at 6:01 p.m. 4. Consider Approval of Resolution Dedicating Revenue of Tax Increment Reinvestment Zone No. 1 to the Repayment of Certificates of Obligation MOTION by Mark McClinton, second by Gerald Cook, to approve Resolution No. 2020-R- 09 Dedicating Revenue from TIRZ No. 1 to the Repayment of Certificates of Obligation. MOTION CARRIED by unanimous vote. 5. Consider Acceptance of an Easement Agreement Granted by STX Washington Partners, LLC to the City of Stephenville for Easements Located in Lot 2, Block 148, of the City Addition to the City of Stephenville, Erath County, Texas and Lot 3, Block 1, of the Lake Granbury Developers Addition to the City of Stephenville, Erath County, Texas MOTION by Mark McClinton, second by Brandon Huckabee, to accept an Easement Agreement with STX Washington Partners, LLC. MOTION CARRIED by unanimous vote. 6. Consider Approval of a Professional Services Agreement with Gateway Planning, Inc. for Downtown Revitalization This item was removed from the agenda. 7. Consider Acceptance of Certification of Unopposed Candidates and Approval of an Order Cancelling the May 2, 2020 General Election MOTION by Alan Nix, second by Carla Trussell, to accept a Certification of Unopposed Candidates and Approval of Order Cancelling the May 2, 2020 General Election. MOTION CARRIED by unanimous vote. V. Planning and Zoning Commission Steve Killen, Director of Development Services 1. PUBLIC HEARING Case No.: RZ2020-001 City Of Stephenville Regular City Council Meeting - 03 Mar 2020 Applicant is Requesting a Rezone of a Property located at 150 Hurbert, being Lot 3, Block 35, of the Frey First Addition to the City of Stephenville, Erath County, Texas, from Industrial District(I) to Single -Family Residential District (R-1). Steve Killen, Director of Development Services stated that the Planning and Zoning Commission voted 5-2 in favor of the rezone. Mayor Svien opened the public hearing. Joseph Borgess, applicant, spoke in favor of the rezone. No others came forward to speak in favor of or opposition to the rezone. Mayor Svien closed the public hearing. 2. Consider an Ordinance Rezoning a Property Located at 150 Hurbert, Being Lot 3, Block 35, of the Frey First Addition to the City of Stephenville, Erath County, Texas, from Industrial District (1) to Single -Family Residential District (R-1). MOTION by Carla Trussell, second by Brandon Huckabee, to approve Ordinance No. 2020- 0-13 rezoning a property located at 150 Hurbert, being Lot 3, Block 35, of the Frey First Addition from Industrial District (1) to Single -Family Residential District (R-1). MOTION CARRIED by the following votes: Ayes: Carla Trussell, Nick Robinson, Brady Pendleton, Ricky Thurman, and Brandon Huckabee Noes: Mark McClinton, Alan Nix, and Gerald Cook 3. PUBLIC HEARING Case No.: RZ2020-002 Applicant is Requesting a Rezone of a Property Located at 2241 Tarleton, Being Lot 2, Block 3, of the Kaylie Subdivision to the City of Stephenville, Erath County, Texas from Single -Family Residential District (R-1) to Multiple Family Residential District (R-3). Steve Killen, Director of Development Services stated that the Planning and Zoning Commission voted unanimously to recommend denying the request. Mayor Svien opened the public hearing. MOTION by Brady Pendleton, second by Brandon Huckabee, to approve an ordinance rezoning the property located at 2241 Tarleton, being Lot 2, Block 3, of the Kaylie Subdivision to the City of Stephenville, Erath County, Texas from Single -Family Residential District (R-1) to Multiple Family Residential District (R-3). Consider Ordinance Rezoning a Property Located on Tarleton Street, Being Lot 1, Block 3, of the Kaylie Subdivision to the City of Stephenville, Erath County, Texas from Single - Family Residential District (R-1) to Multiple Family Residential District (R-3). MOTION by Mark McClinton, second by Alan Nix, to deny the request to rezone the property being Lot 1, Block 3 of the Kaylie Subdivision to the City of Stephenville, Erath County, Texas from Single -Family Residential District (R-1) to Multiple Family Residential District (R-3). PUBLIC HEARING Case No.: SV2020-003 Applicant is Requesting a Waiver from the Subdivision Ordinance of the City of Stephenville, Section 155.6.11 Sidewalks for the Property Located at 695 Prairie Wind, Being Lot 28, Block 7, of the River North II Addition to the City of Stephenville, Erath County, Texas Steve Killen, Director of Development Services stated that the Planning and Zoning Commission voted unanimously to recommend approval of the waiver. Mayor Svien opened the public hearing. No one came forward to speak in favor of or opposition to the request. Mayor Svien closed the public hearing. 8. Consider Waiver from the Subdivision Ordinance of the City of Stephenville, Section 155.6.11 Sidewalks for the Property Located at 695 Prairie Wind, Being Lot 28, Block 7, of the River North II Addition to the City of Stephenville, Erath County, Texas MOTION by Carla Trussell, second by Mark McClinton, to approve the waiver requiring sidewalks at 695 Prairie Wind. Planning and Development Services Committee Brandon Huckabee, Chair 1. Committee Report 2020.02.18 Council member Huckabee gave the committee report. 2. Consider Approval of a Resolution Adopting the City of Stephenville Residential Incentives Program MOTION by Brandon Huckabee, second by Mark McClinton, to approve Resolution No. 2020-R-10 Adopting the City of Stephenville Residential Incentives Program. MOTION TO AMEND by Carla Trussell, second by Brandon Huckabee, to amend the phrase "improvement value" to "investment value" in the third paragraph. MOTION to approve Resolution No. 2020-R-10 Adopting the City of Stephenville Residential Incentives Program as amended. MOTION CARRIED by unanimous vote. VII. Parks and Leisure Services Committee Report Nick Robinson, Chair 1. Parks and Leisure Services Report Council member Nick Robinson gave the committee report. 2. Consider Approval of Bid Award from Slide Experts for Splashville Refurbishments MOTION by Nick Robinson, second by Brandon Huckabee, to approve the bid award from City Of Stephenville Regular City Council Meeting - 03 Mar 2020 Slide Experts for Splashville Refurbishments. MOTION CARRIED by unanimous vote. Vill. Finance Committee Mark McClinton, Chair 1. Finance Committee Report Council member Mark McClinton gave the committee report. 2. Consider Approval of Architect's Services Agreement with RDBR, PLLC for Facility Design MOTION by Mark McClinton, second by Nick Robinson, to approve an Architect's Services Agreement with RDBR, PLLC for facility design in the amount of $18,500. MOTION CARRIED by unanimous vote. IX. MONTHLY BUDGET REPORT Monica Harris, Director of Finance, gave the following budget report: In reviewing the financial statements ending January 31, 2020, the financial indicators are as or a little less than expected. Property Tax - We received $3 million in property taxes in the month of January, resulting in a $349K or 6.11% increase over funds collected through January last fiscal year. The $6 million collected through January is 94% of budget, which is consistent with the prior year collections. Sales Tax - We received $495K in sales tax in January, resulting in $15K or 0.70% under the target budget through January. We received $10K or .45% less than the funds received through last January. HOT Funds - We received $53K in revenue in the Hotel Occupancy Tax fund through January, as compared to $44K in revenue through last January. We spent $74K in Hotel Occupancy Tax funds through January as compared to $63K last year. Revenue (Budgetary comparison) - The target budget for operating revenue is $9.4 million. We received $13 million in revenue through January, resulting in $3.6 million over the target budget. This is a result of property taxes, which are billed October 1st and due by January 31st, and insurance proceeds. Expenditures (Budgetary comparison) - The target budget for operating expenditures is $6.9 million. We expended $6.8 million through January, resulting in $131K under the target budget. Revenue (Prior year comparison) - Operating revenue received last year was $11.9 million as compared to the current year's $13 million, resulting in a $1.2 million increase due to service charges, insurance proceeds, and property taxes. Expenditures (Prior year comparison) - Operating expenditures last year were $6.3 million as compared to the current year's $6.8 million, resulting in a $481K increase due to wages and benefits, maintenance, supplies, utilities, outside professionals, and marketing for SEDA. New Programs - Security cameras for the Municipal Building has been purchased and installed. The Grosebeck storm water drainage project is progressing. X. Approval of an Interlocal Cooperation Contract for the Failure to Appear (FTA) Program with the Texas Department of Public Safety MOTION by Mark McClinton, second by Gerald Cook, to approve the consent agenda as presented. MOTION CARRIED by unanimous vote. XII. Comments by City Manager • Council Committee Meetings - Tuesday, March 17 at 5:30 p.m. • Regular City Council Meeting - Tuesday, April 7 at 5:30 p.m. XIII. Comments by Council Members Mark McClinton thanked the council for their hard work on getting to the point of issuing Certificates of Obligation. Carla Trussell invited everyone to "Pickers and Poets" taking place at the Museum. Nick Robinson invited everyone to Rajun' Cajun benefiting the Cross Timbers Fine Arts Council. Alan Nix stated that it was very encouraging to see the council chambers full and hoped that more citizens would continue to be engaged. Gerald Cook stated that the issuance of Certificates of Obligation is very exciting and he is looking forward to seeing the projects move forward. Brandon Huckabee expressed his excitement about the Harbin Drive Project and thanked everyone for their hard work to get it done. XIV.
