HomeMy WebLinkAbout2017-06-01 - BOA Meeting Minutes MINUTES OF THE BOARD OF ADJUSTMENT OF THE CITY OF STEPHENVILLE, TEXAS HELD ON, Thursday June 1, 2017- 4:00PM The regular meeting of the Board of Adjustment of the City of Stephenville was called to order by Chairman Moumin Quazi at 4:00pm with the following members present: Chairman: Moumin Quazi Members Present: David Baskett Vic Cogburn Steven McKethan Absent: Also attending was Jeremy Allen, Interim of Director of Planning and Building Services, Shyra King, Board of Adjustment Secretary, Cindy Stafford, City Secretary, Allen Barns, City Administrator and members of the community. ITEM I: CONSIDER FOR APPROVAL MINUTES OF THE MAY 11, 2017 MEETING. A. The Minutes of the May 11, 2017 meeting were annulled due to not having a full quorum present. B. Moumin Quazi directed a question to Jeremy Allen on the status of the 5th member for the Board. Mr. Allen explained that the City Council will consider the appointment of Keri Wallace as a Board member, and Brandon Huckabee as an alternate to the Board of Adjustment at their scheduled June 6th meeting. C. Chairman Moumin Quazi, wished to state for the record, that people of the community have voiced concern with the progress in terms of Stephenville’s development, but the Board of Adjustment’s function was to hear and rule on requests for appeals and Variances, from current ordinances, and that they did not have the authority to make changes to those ordinances or laws. ITEM II: Public Hearing Case No.: V2017‐005: Applicant(s), Winsett Reddoch, and Verdad Real Estate, Inc., are requesting a 120.632 square foot Variance from Section 12: Sign Regulations, of the City Of Stephenville Zoning Ordinance, in order to install a “Commercial Pole Sign” in a (B-2) Retail and Commercial Business zoned district, with a maximum area of 130.87 square feet, on the property, being approximately 32,750 square feet of land located at 3011 West Washington Street, City of Stephenville, Erath County, Texas, being a portion of Parcel ID No. R000023759 as depicted on exhibit “A”. Jeremy Allen, Interim Director of Planning and Building Services, addressed the Board, explaining the Variance request made by Verdad Real Estate Inc. to allow for a larger area of advertisement on a pole sign than currently allowed by ordinance, for the proposed Burger King restaurant at this location. Staff recommendation was no objection to the Variance request. Chairperson Moumin Quazi opened the public hearing. THOSE IN FAVOR OF THE VARIANCE REQUEST: Carla Trussel and Doug Montgomery spoke in favor of the requested Variance. There was no one present to speak on behalf of the applicant(s). THOSE NOT IN FAVOR OF THE VARIANCE REQUEST: Lisa LaTouche spoke on behalf of the Owner Operators of Sonic Drive-In (Jacob & Sheryl DiJulio) and in opposition of the requested Variance. Chairman Moumin Quazi closed the public hearing. Board member Steven McKethan made a motion to approve the Variance request as submitted for Case No.: V2017-005 Board member Vic Cogburn seconded the motion. The motion carried by the following vote. AYES: Three members present voted aye. NOES: One member present voted nay. ITEM lll: Public Hearing Case No.: V2017‐006: Applicants, Winsett Reddoch, and Verdad Real Estate, Inc., are requesting a 48.442 square foot Variance from Section 12: Sign Regulations, of the City Of Stephenville Zoning Ordinance, in order to install a “Commercial Pole Sign” in a (B-2) Retail and Commercial Business zoned district, with a maximum area of 94.87 square feet, on the property, being approximately 32,750 square feet of land located at 3011 West Washington Street, City of Stephenville, Erath County, Texas, being a portion of Parcel ID No. R000023759 as depicted on exhibit “A”. Jeremy Allen, Interim Director of Planning and Building Services, addressed the Board, explaining the Variance request made by Verdad Real Estate Inc. to allow for a larger area of advertisement on a pole sign than currently allowed by ordinance, for the proposed Burger King restaurant at this location. THOSE NOT IN FAVOR OF THE VARIANCE REQUEST: No persons spoke on behalf of not approving the requested Variance. Chairman Moumin Quazi closed the public hearing. Board member David Baskett made a motion to approve the Variance request as submitted for Case No.: V2017-006 Board member Steven McKethan seconded the motion. The motion carried by the following vote. AYES: All members present voted aye.
