The City Council of said City convened in SPECIAL MEETING ON THE 24TH DAY OF APRIL, 2018, at the designated meeting place, and the roll was called of the duly constituted officers and members of said City Council,to wit: Jerry K. Weldon, II, Mayor Doug Svien, Mayor Pro-tem Mark McClinton Carla Trussell Brady Pendleton Rhett Harrison Alan Nix Sherry Zachery Jerry Warren and all of said persons were present except the following absentee: Jerry Warren, thus constituting a a. quorum. Whereupon, among other business, the following was transacted at said Meeting: a written RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION AND RESOLVING OTHER MATTERS PERTAINING THERETO was duly introduced for the consideration of said City Council. It was then duly moved and seconded that said Resolution be adopted and, after due discussion, said motion, carrying with it the adoption of said Resolution, prevailed with all members of the Council shown above as being present voting "Aye,"except as set forth below: ABSTAIN: NONE NO: NONE 2. A true, full and correct copy of the aforesaid Resolution adopted at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; said Resolution has been duly recorded in said City Council's minutes of said Meeting; the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the adoption of said Resolution;the persons named in the above and foregoing paragraph are the duly chosen,qualified and acting officers and members of said City Council as indicated therein;each of the officers and members of said City Council was duly and sufficiently notified officially and a personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for adoption at said Meeting, and each of said officers and members consented,in advance,to the holding of said Meeting for such purpose; said Meeting was open to the public; and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551,Texas Government Code. -- 3. Attached hereto is a form of the Notice of Intention to issue Certificates of Obligation,the form and substance of which is hereby adopted and approved. Section 2. """ if Allen Barnes, cp'ty Administr or Reviewed / \ v 3 a —,.____ Randy Thomas, City Attorney Approved as to form and legality CITY OF STEPHENVILLE,TEXAS NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION The City of Stephenville does hereby give notice of intention to issue one or more series of its Certificates of Obligation, in the maximum principal amount not to exceed $17,030,000, for paying all or a portion of the City's contractual obligations incurred in connection with planning, acquiring, designing and constructing improvements to the City's sewer system, including such obligations relating to the eastside sewer project and paying legal,fiscal,engineering and architectural fees in connection with this project. The City proposes to adopt an ordinance which will provide that the Certificates of Obligation shall be secured by a pledge of funds received from the levy and collection of ad valorem taxes in the City as provided by law, and from a pledge of the surplus net revenues of the City's combined Waterworks and Sewer System (the "System"), that remain after paying all operation and maintenance expenses of the System, and all debt service,reserve,and other requirements in connection with all of the City's revenue bonds or other obligations (now or hereafter outstanding),which are payable from all or any part of the net revenues of the System. The City Council intends to consider for passage at a meeting to be held at 5:30 P.M.on June 5,2018,an ordinance authorizing the issuance of the Certificates of Obligation, at the City Hall, 298 West Washington Street, Stephenville,Texas.
